4. Where the information concerned is classified at the level CONFIDENTIEL UE/EU CONFIDENTIAL or its equivalent, access shall be granted to those Members of the European Parliament who have been authorised by the President pursuant to paragraph 5 or after having signed a solemn declaration of non-disclosure of the content of that information to third persons, of compliance with the obligation to protect information classified at the level CONFIDENTIEL UE/EU CONFIDENTIAL and of acknowledgement of the consequences of any failure to do so.

Highlights the importance of ensuring that the procedural guarantees given to the parties in their respective legal systems are respected; calls for the establishment of safe mechanisms for the use and transmission of confidential information; calls on the Commission to ensure the attractiveness of leniency programmes and settlement procedures, taking into account the general principle governing the exchange of confidential information enshrined in this agreement; stresses, therefore, the importance of protecting documents relating to leniency applications or settlement procedures, in particular from potential future disclosure in the context of civil or criminal proceedings, in order to provide leniency applicants and parties to a settlement procedure with a guarantee that those documents will not be transmitted or used without their prior consent; emphasises that the protection of personal data and business secrecy must be fully guaranteed;

5. All persons required to handle confidential information shall be thoroughly briefed on security procedures, the dangers of indiscreet conversation and their relationships with the media, and shall, where appropriate, sign a declaration that they will not disclose the contents of confidential information to third persons, that they will respect the obligation to protect classified information and that they acknowledge the consequences of any failure to do so.

26. Les SIC traitant des informations classifiées aux niveaux CONFIDENTIEL UE/ EU CONFIDENTIAL, SECRET UE/EU SECRET, TRÈS SECRET UE/EU TOP SECRET ou à leurs équivalents sont protégés de telle manière que les informations ne peuvent pas être compromises par des émissions électromagnétiques non intentionnelles («mesures de sécurité Tempest»).
26. CIS handling information classified at the level CONFIDENTIEL UE/EU CONFIDENTIAL, SECRET UE/EU SECRET or TRÈS SECRET UE/EU TOP SECRET, or its equivalent shall be protected in such a way that the information cannot be compromised by unintentional electromagnetic emanations (‘TEMPEST security measures’).

6.
