Stresses its serious concerns about the work carried out within the Council of Europe’s Cybercrime Convention Committee with a view to developing an additional protocol on the interpretation of Article 32 of the Convention on Cybercrime of 23 November 2001 on ‘trans-border access to stored computer data with consent or where publicly available’ in order to ’facilitate its effective use and implementation in the light of legal, policy and technological developments’; calls on the Commission and the Member States, in view of the forthcoming consideration by the Committee of Ministers of the Council of Europe, to ensure the compatibility of the provision of Article 32 of the Convention on Cybercrime, and its interpretation in the Member States, with fundamental rights, including data protection and, in particular, the provisions on trans-border flows of personal data, as enshrined in the EU Charter of Fundamental Rights, the EU data protection acquis , the European Convention of Human Rights and the Council of Europe Convention on the Protection of Individuals with Regard to Automatic Processing (‘Convention 108’), which are legally binding upon the Member States; calls on the Commission and the Member States to reject firmly any measure that would put the application of these rights at risk; is alarmed by the fact that should such an additional protocol be endorsed, its implementation could result in unfettered remote access by law enforcement authorities on servers and computer systems located in other jurisdictions, without recourse to MLA agreements and other instruments of judicial cooperation put in place to guarantee the fundamental rights of the individual, including data protection and due process;

La proposition de protocole présentée par l'AOSIS et les suggestions de la délégation allemande feront également partie des négociations. c) Rapport du groupe ad hoc à la deuxième Conférence des Parties sur l'état des négociations relatives au protocole ; conclusion des négociations six mois avant la troisième Conférence des Parties afin de permettre l'adoption de ce protocole lors de cette conférence. d) Inclusion dans le programme de travail du groupe ad hoc, en coopération avec les autres organes subsidiaires, d'une analyse ou d'une évaluation visant à définir les possibilités ainsi que les politiques et mesures qui permettraient de limiter et de réduire progressivement les émissions de gaz à effet de serre. e) Examen des éléments-clés ci-après à inclure dans le protocole : i) caractère global du protocole qui couvrira tous les gaz à effet de serre, leurs sources et puits et tous les secteurs concernés ; ii) responsabilités communes mais différenciées des parties en fonction de leurs capacités et possibilités respectives : - responsabilité première des parties visées à l'annexe I qui prendront individuellement ou conjointement des engagements spécifiques renforçant et élargissant les engagements pris au titre de l'article 4 paragraphe 2 points a) et b) de la convention ; - participation à terme des parties non visées à l'annexe I conformément à l'article 4 paragraphe 2 points f) et g) ; mise en place d'un cadre qui aboutira à des schémas de développement économique durables qui assureront une croissance économique en constante augmentation tout en diminuant l'accroissement des émissions de gaz à effet de serre ; iii) approche combinée incluant à la fois des politiques et des mesures ainsi que des objectifs et des échéances, telles que 2005 et 2010, compte tenu des différences quant au point de départ et à l'approche, à la structure économique et à la base de ressources, comme indiqué à l'article 4 paragraphe 2 point a) ; iv) politiques et mesures coordonnée ...
The AOSIS protocol proposal and the German delegation's suggestions will as well as others form part of the negotiations (c) Report of the ad hoc group to the second Conference of the Parties on the state of negotiations on the protocol; completion of the negotiations six months before the third Conference of the Parties in order to allow adoption during that Conference (d) Inclusion in the ad hoc group's working programme, in cooperation with the other subsidiary bodies, of an analysis or assessment to identify potential and possible policies and measures for achieving limitations and progressive reductions of greenhouse gas emissions (e) Consideration of the following key elements for inclusion in the protocol: (i) comprehensiveness of the protocol, covering all greenhouse gases, their sources and sinks and all relevant sectors; (ii) common but differentiated responsibilities of Parties in line with their respective capabilities and possibilities: - lead responsibility of Annex I Parties through specific commitments, individually or jointly, strengthening and enlarging those undertaken in Article 4(2)(a) and (b) of the Convention, - participation, over time, of non-Annex I Parties as recognized in Article 4(2)(f) and (g); establishment of a framework leading to sustainable patterns of economic development that will secure steadily increasing economic growth while restraining the growth of greenhouse gas emissions; (iii) combined approach including both policies and measures as well as targets and timetables such as 2005 and 2010, taking into account the differences in starting points and approaches, economic structures and resource bases as set out in Article 4(2)(a); (iv) coordinated policies and measures covering CO2 and other greenhouse gases, in particular in those areas where international coordination is called for in view of competitiveness concerns, priority being given to: - measures subject to competitiveness concerns; - measures concerning globall ...

The negotiations are intended to reach agreement on proposed amendments to Convention No 108, in the form of a Protocol, in the light of the European Community Directive 95/46/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data and in the light of Directive 97/66/EC concerning the processing of personal data and the protection of privacy in the telecommunications sector.
