36. Notes the improvement of road transport and mobility infrastructure, in particular with regard to motorways, as well as the recent adoption of the 2015 IPA II package, which includes Kosovo’s major railway infrastructure project; regrets, however, the high construction costs; hopes that the recent loan agreement signed between Kosovo and the European Investment Bank for the modernisation of the Kosovo part of the European Rail Route 10 network can give a boost to a comprehensive plan for improving public transport and upgrading railway infrastructure; calls on the Kosovo authorities – bearing in mind that the Commission has made the connectivity agenda one of its highest priorities and regards it as the key factor for the region’s economic development – to ensure the full and swift implementation of the technical standards and soft measures in the transport field which were agreed during the 2015 Western Balkans Summit in Vienna;

Sans préjudice du paragraphe 3, les États membres peuvent exclure du champ d'application de l'article 8, paragraphe 3, les infrastructures ferroviaires locales et régionales qui ne revêtent pas une importance stratégique pour le fonctionnement du marché ferroviaire, et du champ d'application du chapitre IV les infrastructures ferroviaires locales qui ne revêtent pas une importance stratégique pour le fonctionnement du marché ferroviaire. Les États membres notifient à la Commission leur intention d'exclure ce type d'infrastructures ferroviaires.
4. Without prejudice to paragraph 3, Member States may exclude local and regional railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Article 8(3) and local railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Chapter IV. Member States shall notify the Commission of their intention to exclude such railway infrastructures.

Since the objectives of this Directive, namely to foster the development of the Union railways, to set out broad principles for granting licences to railway undertakings and to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof, cannot be sufficiently achieved by the Member States on account of the manifestly international dimension of issuing such licences and operating significant elements of the railway networks, and of the need to ensure fair and non-discriminatory terms for access to the infrastructure, and can therefore, by reason of their trans-national implications, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

This was the main rationale for Directive 2004/49/EC on safety on the Community's railways and amending Council Directive 95/18/EC on the licensing of railway undertakings and Directive 2001/14/EC on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure and safety certification (the Railway Safety Directive (3); : safety should be further improved, when reasonably practicable and taking into account the competitiveness of the rail transport mode.
