This part of the paper relates to four key issues related to the Community interest test.

1. Lorsqu’un produit est importé dans la Communauté en quantités tellement accrues ou à des conditions ou selon des modalités telles qu’un préjudice grave est porté ou risque d’être porté aux producteurs communautaires de produits similaires ou directement concurrents, la Commission, afin de sauvegarder les intérêts de la Communauté, peut, à la demande d’un État membre ou de sa propre initiative, modifier le régime d’importation du produit en question en subordonnant sa mise en libre pratique à la présentation d’une autorisation d’importation à octroyer selon les modalités et dans les limites définies par la Commission.
1. Where a product is imported into the Community in such greatly increased quantities or on such terms or conditions as to cause, or threaten to cause, serious injury to Community producers of like or directly competing products, the Commission, in order to safeguard the interests of the Community, may, acting at the request of a Member State or on its own initiative, alter the import rules for that product by providing that it may be put into free circulation only on production of an import authorisation, the granting of which shall be governed by such provisions and subject to such limits as the Commission shall lay down.

9. Aucune disposition du présent article ne porte atteinte au droit des États membres d’exercer un contrôle légal au niveau national afin de protéger des intérêts légitimes en matière de sécurité publique, conformément au droit communautaire.
9. Nothing in this Article shall affect the right of Member States to exercise, in compliance with Community law, national legal controls to protect legitimate public security interests.

Lorsque les intérêts de la Communauté l'exigent, le Conseil, statuant à la majorité qualifiée sur proposition de la Commission établie dans les conditions prévues au chapitre III, peut arrêter les mesures appropriées pour empêcher qu'un produit ne soit importé dans la Communauté en quantités tellement accrues et/ou à des conditions ou selon des modalités telles qu'un dommage grave est porté ou risque d'être porté aux producteurs communautaires de produits similaires ou directement concurrents.
Where the interests of the Community so require, the Council, acting by a qualified majority on a proposal from the Commission drawn up in accordance with the terms of Chapter III, may adopt appropriate measures to prevent a product being imported into the Community in such greatly increased quantities and/or on such terms or conditions as to cause, or threaten to cause, serious injury to Community producers of like or directly competing products.

La présente directive ne porte pas atteinte à la faculté des États membres de définir, conformément au droit communautaire, ce qu'ils entendent par services d'intérêt économique général, la manière dont ces services devraient être organisés et financés conformément aux règles relatives aux aides d'État ou les obligations spécifiques auxquelles ils doivent être soumis.
This Directive does not affect the freedom of Member States to define, in conformity with Community law, what they consider to be services of general economic interest, how those services should be organised and financed, in compliance with the State aid rules, and what specific obligations they should be subject to.

4. La présente décision ne porte pas atteinte aux mesures prises au niveau communautaire ou national, dans le respect du droit communautaire, pour poursuivre des objectifs d'intérêt général, notamment en ce qui concerne la réglementation en matière de contenus et la politique audiovisuelle, ni aux dispositions de la directive 1999/5/CE, ni au droit des États membres d'organiser leur gestion du spectre radioélectrique et de l'utiliser à des fins d'ordre public, de sécurité publique et de défense.
4. This Decision is without prejudice to measures taken at Community or national level, in compliance with Community law, to pursue general interest objectives, in particular relating to content regulation and audio-visual policy, to the provisions of Directive 1999/5/EC and to the right of Member States to organise and use their radio spectrum for public order and public security purposes and defence.

(2) considérant que les mécanismes existant actuellement, tant sur le plan national que sur le plan communautaire, pour assurer le respect de ces directives ne permettent pas toujours de mettre un terme, en temps utile, aux infractions préjudiciables aux intérêts collectifs des consommateurs; que, par intérêts collectifs, on entend des intérêts qui ne sont pas une simple accumulation d'intérêts de particuliers auxquels il a été porté atteinte par une infraction; que cela est sans préjudice des recours individuels formés par des particuliers lésés par une infraction;
(2) Whereas current mechanisms available both at national and at Community level for ensuring compliance with those Directives do not always allow infringements harmful to the collective interests of consumers to be terminated in good time; whereas collective interests mean interests which do not include the cumulation of interests of individuals who have been harmed by an infringement; whereas this is without prejudice to individual actions brought by individuals who have been harmed by an infringement;

2. Par dérogation au paragraphe 1, le bénéfice du régime du perfectionnement passif peut être accordé à une autre personne pour les marchandises d'origine communautaire au sens du titre II chapitre 2 section 1 lorsque l'opération de perfectionnement consiste en l'incorporation de ces marchandises à des marchandises obtenues hors de la Communauté et importées comme produits compensateurs, pour autant que le recours au régime contribue à favoriser la vente des marchandises d'exportation, sans qu'il soit porté atteinte aux intérêts essentiels des producteurs communautaires de produits identiques ou similaires aux produits compensateurs importés.
2. By way of derogation from paragraph 1, authorization to use the outward processing procedure may be granted to another person in respect of goods of Community origin within the meaning of Title II, Chapter 2, Section 1, where the processing operation consists in incorporating those goods into goods obtained outside the Community and imported as compensating products, provided that use of the procedure helps to promote the sale of export goods without adversely affecting the essential interests of Community producers of products identical or similar to the imported compensating products.
