(5) If the employer fails to file a report required by an order made under subsection (1) or (2), the Board may, by order, grant another period of time to file the report or, if the Board considers that there are exceptional circumstances to justify doing so, declare that the employer has committed a manifestly unreasonable error described in subsection (3). If the Board makes that declaration, subsection (3) applies.

3. Further insists on striking a political agreement on: a compulsory and comprehensive revision of the Multiannual Financial Framework (MFF), granting extra financial means for growth, jobs and social cohesion; maximum overall flexibility, enabling the EU’s reinforcement of political priorities; a roadmap to reform the EU financing system, on the basis of a genuine own-resources system and of ensuring the unity of the budget; recalls that if no MFF has been adopted by the end of 2013, the ceilings and other provisions corresponding to 2013 will be extended until a new MFF is adopted; stresses that it will only vote on the MFF Regulation and the Interinstitutional Agreement after the satisfactory conclusion of extensive negotiations with the Council;

Les autorités compétentes ne donnent leur approbation à l’accord d’interopérabilité que si les contreparties centrales concernées ont été autorisées à procéder à la compensation selon la procédure prévue à l'article 13 et ont sans discontinuer rempli leur rôle lors de la compensation des contrats dérivés, au titre de cette autorisation, conformément aux exigences prudentielles pendant au moins trois ans, si les exigences énoncées à l’article 49 sont remplies, si les conditions techniques régissant la compensation des transactions selon les modalités de l’accord sont conciliables avec un fonctionnement harmonieux et ordonné des marchés financiers et si l’accord ne nuit pas à l’efficacité de la surveillance.
2. The competent authorities shall only grant approval of the interoperability arrangement where the CCPs involved have been authorised to clear under the procedure set out in Article 13 and have continuously fulfilled their role in clearing the derivative contracts under that authorisation in accordance with supervisory requirements for a period of at least three years, the requirements set out in Article 49 are met and the technical conditions for clearing transactions under the terms of the arrangement allow for a smooth and orderly functioning of financial markets and the arrangement does not undermine the effectiveness of supervision.

4. rappelle que dans la déclaration conjointe sur le financement des programmes européens de navigation par satellite faisant suite à l'accord du 23 novembre 2007 sur la question, le Parlement européen et le Conseil ont confirmé que l'estimation du montant total nécessaire à la pleine capacité fonctionnelle du projet de navigation par satellite Galileo était de 3 400 000 000 EUR pour la période 2007-2013 et déclaré que ce montant ne devait pas dépasser la durée du cadre financier 2007-2013; se dit toutefois convaincu que, dans le cadre financier actuel, ces estimations sont insuffisantes pour mettre en place un service opérationnel efficace et compétitif et rattraper le retard technologique d'ici 2013; regrette par conséquent que dans son examen à mi-parcours de janvier 2011, la Commission n'ait pas proposé de financement supplémentaire pour les programmes de navigation par satellite pour la période allant jusque 2013, ce qui pourrait entraîner des retards inacceptables dans leur achèvement; souligne que si des moyens financiers supplémentaires s'avéraient indispensables au cours de cette période, il ne saurait être question ni de redéployer les programmes pluriannuels actuels ni de réduire encore les crédits de la rubrique 1a, notamment ceux du 7 programme-cadre;

Recalls that in the joint statement on the financing of the European GNSS programmes following the relevant agreement of 23 November 2007, Parliament and the Council confirmed that the estimated total amount needed for Full Operational Capability of the GNSS Galileo project is EUR 3 400 million for the 2007-2013 period, and declared that this amount should not be exceeded for the duration of the 2007-2013 financial framework; is convinced, however, that these estimates in the current financial framework are inadequate for bringing an efficient, competitive service into operation and ensuring the necessary technological linkage by 2013; deplores the fact, therefore, that in its January 2011 mid-term review the Commission did not propose any additional funding for the GNSS programmes for the period up to 2013, which may lead to unacceptable delays in their completion; points out that, should extra funds be needed during this period, redeployment from current multiannual programmes cannot be seen as a viable option, and that further reductions under Heading 1a, in particular concerning the 7th Framework Programme, are unacceptable;
