Given the fact that European patent applications may be filed in any language under Article 14(2) of the EPC, in accordance with Article 12 of Regulation xx/xx [substantive provisions], the participating Member States, shall give, within the meaning of Article 143 of the EPC, the European Patent Office the task of administering a compensation scheme of reimbursing all translation costs up to a ceiling, from the fees referred to in Article 13 of that Regulation, for applicants filing patent applications at the European Patent Office in one of the official languages of the Union that is not an official language of the European Patent Office.

Given the fact that European patent applications may be filed in any language under Article 14(2) of the EPC, in accordance with Article 9 of Regulation (EU) No [.../2012] of the European Parliament and of the Council implementing enhanced cooperation in the area of the creation of unitary patent protection , the participating Member States, shall give, within the meaning of Article 143 of the EPC, the European Patent Office the task of administering a compensation scheme of reimbursing all translation costs up to a ceiling, from the fees referred to in Article 10 of that Regulation, for applicants filing patent applications at the European Patent Office in one of the official languages of the Union that is not an official language of the European Patent Office.

2. Reasonable compensation shall be due only if the applicant has either communicated to the person using the invention or filed with the Office a translation of the claims which the Office has made available to the public and which is in the official language of the Member State in which the person using the invention has his residence or principal place of business or, where that State has more than one official language, in the language which that person has accepted or designated, provided that the contested use constitutes infringement of the application according to the original text of the application and according to the text of the translation.

3. Tout État membre peut, lors de l’adoption de la présente décision-cadre, ou ultérieurement, indiquer dans une déclaration déposée auprès du secrétariat général du Conseil qu’il peut, en tant qu’État d’exécution, dès réception du jugement et du certificat, s’il juge le contenu du certificat insuffisant pour statuer sur l’exécution de la condamnation, demander que le jugement ou ses parties essentielles soient accompagnés d’une traduction dans la langue officielle ou dans l’une des langues officielles de l’État d’exécution ou dans une ou plusieurs autres langues officielles des institutions de l’Union européenne.
3. Any Member State may, on adoption of this Framework Decision or later, in a declaration deposited with the General Secretariat of the Council state that it, as an executing State, may without delay after receiving the judgment and the certificate, request, in cases where it finds the content of the certificate insufficient to decide on the enforcement of the sentence, that the judgment or essential parts of it be accompanied by a translation into the official language or one of the official languages of the executing State or into one or more other official languages of the Institutions of the European Union.

2. Le Conseil voudrait également attirer votre attention sur le fait que, suite à la présentation par la Commission du deuxième rapport sur la cohésion économique et sociale, des représentants des États membres, de la Commission et du Parlement européen se sont rencontrés en juin dernier, à l'initiative de la présidence suédoise du Conseil, à Lycksele, dans le nord de la Suède, pour partager leurs expériences et discuter de l'avenir des zones dépeuplées, y compris les zones rurales, un avenir pour lequel la présidence, que nous assumons ce semestre, continue à travailler.
The Council would also like to draw your attention to the fact that, following the Commission’s presentation of the second report on economic and social cohesion, representatives from the Member States, the Commission and the European Parliament met last June, at the initiative of the Swedish Presidency of the Council, in Lycksele, in the north of Sweden, in order to share their experiences and discuss the future of depopulated zones, including rural areas, a matter on which the presidency that Belgium assumed this quarter, continues to work.
