Lorsque le titulaire d'un brevet concernant une invention biotechnologique ne peut exploiter celle-ci sans porter atteinte à un droit d'obtention végétale antérieur sur une variété, il peut demander une licence obligatoire pour l'exploitation non exclusive de la variété protégée par ce droit d'obtention, moyennant une redevance appropriée.
2. Where the holder of a patent concerning a biotechnological invention cannot exploit it without infringing a prior plant variety right, he may apply for a compulsory licence for non-exclusive use of the plant variety protected by that right, subject to payment of an appropriate royalty.

Dans le cas des variétés pour lesquelles une protection nationale des obtentions végétales a été accordée avant l'octroi de la protection communautaire, mais auxquelles l'article 116 paragraphe 4 quatrième tiret dudit règlement ne s'applique pas, la prorogation visée au paragraphe 1 est diminuée de la plus longue période, exprimée en années, pendant laquelle le ou les titres de protection nationale ont porté effet dans un État membre à l'égard de la même variété, avant l'octroi de la protection communautaire de l'obtention végétale.
2. In the case of varieties for which a national plant variety right was granted prior to the grant of the Community plant variety right, but to which Article 116 (4) 4th indent of the said Regulation does not apply, the extension referred to in paragraph 1 shall be reduced by the longest period in full years during which any national property right or rights granted have been effective in a Member State in respect of the same variety prior to the grant of the Community plant variety right.
