(38) In order to take into account the fact that the French overseas departments belong to a different geographical area, are to a large extent Parties to regional port State control memoranda other than the Paris MOU and have very limited traffic flows with mainland Europe, the Member State concerned should be allowed to exclude those ports from the port State control system applied within the Community,

The refusal of access is applicable to any ship flying the flag of a State whose detention rate falls into the black list or grey list as defined by the Paris MOU which has been detained or issued with a prevention of operation order under Council Directive 99/35/EC more than twice in the course of the preceding 36 months in a port of a Member State or of a State signatory of the MOU.

Le rapport sollicité par le Conseil européen de Séville, ne pourrait en effet se concevoir que comme le fruit des concertations et des échanges avec les régions ultra périphériques et de la prise en considération des mémorandums que les Etats membres concernés ont l'intention de transmettre à la Commission au cours du premier semestre 2003.
The report requested by the Seville European Council can only be generated from the agreements and discussions with the outermost regions and the memoranda which the Member States concerned intend to submit to the Commission during the first half of 2003.
