The freedom left to parties is not unlimited: they may choose any law, even if it has no objective connection with the contract; they may choose the law governing the contract after its conclusion and change their choice at any time during the life of the contract, in certain Member States even in the course of proceedings.

In the minds of the authors of the Convention, such a choice does not constitute a choice of law within the meaning of Article 3, which can only be choice of a body of state law: a contract containing such a choice would be governed by the law applicable in the absence of a choice (Article 4), and it would fall to this law to determine the role to be played by the non-state rules chosen by the parties.
