Ils avancent que le projet de loi est inconstitutionnel, du fait qu’il modifie la Constitution du Canada sur des questions relatives à la reine et à ses représentants, le gouverneur général et le lieutenant-gouverneur, sans le consentement de toutes les assemblées législatives provinciales supposément exigé par l’article 41 de la Loi constitutionnelle de 1982.
On 6 June 2013, two Laval University constitutional law professors, Geneviève Motard and Patrick Taillon, filed a motion for declaratory judgment with the Quebec Superior Court challenging the constitutional validity of Bill C-53.46 They argue that the bill is unconstitutional as it amends the Constitution of Canada on matters related to the Queen, and her representatives the Governor General and Lieutenant Governors, without the consent of all the provincial legislative assemblies allegedly required pursuant to section 41 of the Constitution Act, 1982.
