Notes the UN's apparent failure properly to apply the financing agreement signed between the Commission and it regarding the European Agency for Reconstruction, leaving the Court frequently unable to carry out adequate financial control of payments and underlying documents concerning contracts managed or overseen by the United Nations Mission in Kosovo (UNMIK); notes the statement by the Deputy Special Representative of the Secretary-General of the United Nations to grant full access to all files at the request of the Court; urges however the Commission to review the financing agreement with the UN; is of the opinion that a possible phasing out of the European Agency for Reconstruction should not be done according to a pre-set timetable but should depend on economic and political criteria and developments, making full use of the added value of the Agency in terms of expertise and know-how developed over the years, and asks the Commission to bring forward a proposal after a proper final evaluation to see whether the mandate of the reconstruction agency could be altered in such a way that that existing expertise and know-how could be used to provide reconstruction assistance wherever needed, for example in Iraq, Afghanistan, Pakistan, India and the countries affected by the Tsunami, as a second stage after immediate humanitarian needs have been addressed by the Humanitarian Aid Office;

The legislation aims to: broaden privileges and immunities to permanent missions accredited to international organizations; authorize ministers to make orders with retroactive effect under the act for the purposes of granting tax relief; clarify the act to grant privileges and immunities to political subdivisions of foreign states; authorize ministers to take limited orders under the act and provide legal framework needed to authorize retaliatory countermeasures in the areas of customs, the areas of infringements of the Vienna convention on diplomatic relations or the Vienna on consular relations with foreign states; and finally clarify the government's statute with respect to the importation of alcohol by foreign missions.

L. whereas the reactors in the Ignalina nuclear power plant are of a type that does not make it possible to achieve a sufficient level of safety and they therefore must be closed down; whereas principles and a timetable for the decommissioning of the reactors have been agreed between Lithuania, the Nuclear Safety Account (NSA) as managed by the European Bank for Reconstruction and Development and the EU; whereas the Lithuanian Parliament, the Seimas, has adopted a law on the closure of unit 1 at Ignalina in 2004 and the Lithuanian Energy Strategy states that a decision on the closure of unit 2 will be taken in the same year; whereas the NSA agreement prohibits re-channelling of the reactors, while the EU agreement implies that running the plant too long without re-channelling, or re-channelling, is in breach of the NSA Agreement,
