IN-CONTEXT TRANSLATIONS

Il existe deux grandes pratiques en matière d'arrestation dans les États membres: i) l'arrestation à l'issue d'un contrôle de police routinier ou d'une opération ciblée dans un lieu où l'on peut raisonnablement soupçonner que des migrants sans papiers sont présents, et ii) l'arrestation, à la demande des autorités chargées de l'immigration, de personnes qui ne se sont pas conformées à un ordre de quitter le territoire ou à une décision de départ volontaire.
There are two main types of apprehension practices in Member States: First, apprehension on the basis of routine police controls or targeted operations on sites where there is a reasonable suspicion that undocumented migrants are present. Second, apprehensions initiated at the request of the immigration authorities with regard to persons not respecting an order to leave the territory or not complying with a decision to depart voluntarily.

If two or more Member States have issued an alert for the same person, the decision on which warrant shall be executed in the event of an arrest shall be taken by the executing judicial authority in the Member State where the arrest occurs.

If an arrest cannot be made, either because a requested Member State refuses in accordance with the procedures on flagging set out in Articles 24 or 25, or because, in the case of an alert for arrest for extradition purposes, an investigation has not been completed, the requested Member State must regard the alert as being an alert for the purposes of communicating the whereabouts of the person concerned.

It is also true, however, that this constitutional reform contains three elements that impair its credibility. First of all, it ceases to class as crimes actions that are still crimes because they fulfil the conditions as such. Secondly, the constitution is being reformed, but other laws remain in force, such as the Penal Code, the anti-terrorism law and the audiovisual law, which continue to uphold the existence of certain crimes of expression, of opinion, of public demonstration and association. Thirdly, and most importantly, the constitutional reform is not being put into practice. Arbitrary detentions and violations of human rights continue to take place.
