In cooperation with the Member States, the Commission and the High Representative will: · Work towards a coherent EU International cyberspace policy to increase engagement with key international partners and organisations, to mainstream cyber issues into CFSP, and to improve coordination of global cyber issues; · Support the development of norms of behaviour and confidence building measures in cybersecurity. Deplores the fact that a number of legal provisions such as Articles 301, 318 and 220(6), in combination with Article 314(2), of the Penal Code, and Article 7(2) of the anti-terror law, Law No 5816 of 25 July 1951 – as well as statements by the Government and activities by public prosecutors – continue to limit freedom of expression; reiterates its call to the Government to finalise the review of the legal framework on freedom of expression and, without delay, to bring it into line with the ECHR and the case law of the European Court of Human Rights; restates, in this context, the need for the Turkish Government to issue clear guidance to prosecutors in relation to laws that are frequently used to limit freedom of expression; deplores the repeated and disproportionate recourse to closure of websites and asks the Government to prepare amendments to the internet law (Law No 5651) in order to make sure that it no longer restricts freedom of expression or the right of citizens to access information;

Reiterates its concern regarding restrictions on Internet content, whether they apply to the dissemination or to the receipt of information, that are imposed by governments and are not in strict conformity with the guarantee of freedom of expression; in this respect, requests the Council and the Commission to draw up Community rules on trade with third countries concerning goods, including software, hardware and other similar items, the sole purpose of which is to conduct general surveillance activities and to restrict access to the Internet in a manner inconsistent with freedom of expression, and the import and export of such goods, with the exception of goods the sole purpose of which is the protection of children; considers that the same should apply as regards surveillance and/or military technology destined for countries which are systematic violators of human rights; calls also for concrete solutions to be found in order to prevent European businesses from providing those countries with personal data that may be used to violate such rights, particularly freedom of expression;

The Commission welcomes the clear and unequivocal statement of the World Summit on the primary importance of the information society for democracy and the respect for human rights and fundamental freedoms; in particular the freedom of expression and opinion, as well as the freedom to receive and access information.

(9) Dans bien des cas, la libre circulation des services de la société de l'information peut refléter spécifiquement, dans la législation communautaire, un principe plus général, à savoir la liberté d'expression, consacrée par l'article 10, paragraphe 1, de la convention de sauvegarde des droits de l'homme et des libertés fondamentales, qui a été ratifiée par tous les États membres. Pour cette raison, les directives couvrant la fourniture de services de la société de l'information doivent assurer que cette activité peut être exercée librement en vertu de l'article précité, sous réserve uniquement des restrictions prévues au paragraphe 2 du même article et à l'article 46, paragraphe 1, du traité. La présente directive n'entend pas porter atteinte aux règles et principes fondamentaux nationaux en matière de liberté d'expression.
(9) The free movement of information society services can in many cases be a specific reflection in Community law of a more general principle, namely freedom of expression as enshrined in Article 10(1) of the Convention for the Protection of Human Rights and Fundamental Freedoms, which has been ratified by all the Member States; for this reason, directives covering the supply of information society services must ensure that this activity may be engaged in freely in the light of that Article, subject only to the restrictions laid down in paragraph 2 of that Article and in Article 46(1) of the Treaty; this Directive is not intended to affect national fundamental rules and principles relating to freedom of expression.
