(Return tabled) Question No. 443 Ms. Anne Minh-Thu Quach: With regard to the dismantling or transformation of the cargo ship Kathryn Spirit by the company Groupe Saint-Pierre: (a) what federal statutes and regulations apply to the transformation of the ship; (b) which departments are responsible for enforcing the statutes and regulations in this type of situation; (c) has Environment Canada assessed the environmental risks of the operation; (d) has Environment Canada attended any meetings with Groupe St-Pierre and other departments or levels of government; (e) what was the outcome of those meetings; (f) what are Environment Canada’s evaluation criteria for this type of operation; (g) what were the results of the environmental assessment; (h) what measures has Environment Canada or any other federal department taken to ensure that there is no environmental accident before, during or after the operation; (i) what federal standards does this type of operation have to meet; (j) does the company dismantling or transforming the ship have to obtain a certificate of authorization from Environment Canada or any other department before proceeding; (k) what are Canada’s obligations under the Basel Convention in this type of situation; (l) what are the federal government’s and the company’s responsibilities in the event of an environmental accident; (m) has Environment Canada or any other federal department compiled a list or is it aware of other similar operations undertaken elsewhere in Canada; (n) has Environment Canada ever refused to allow an operation of this type to proceed; (o) where is the ship from; and (p) what portion of liability do the federal government and the provincial government bear in this type of situation?

Canada was anxious to have the conference on environment and development, which would be a decade or more after the Stockholm conference on the human environment, but Brazil and Canada agreed finally that they may have had more votes in the United Nations.

In view of its responsibilities for the protection of the environment, the Community signed on 24 June 1998 the Protocol to the 1979 Convention on Long-Range Transboundary Air Pollution on Persistent Organic Pollutants, hereinafter "the Protocol", and on 22 May 2001 the Stockholm Convention on Persistent Organic Pollutants, hereinafter "the Convention".

Compte tenu notamment du principe de précaution, le présent règlement a pour objectif la protection de la santé humaine et de l'environnement contre les polluants organiques persistants en interdisant, en éliminant le plus rapidement possible ou en limitant la production, la mise sur le marché et l'utilisation des substances visées par la convention de Stockholm sur les polluants organiques persistants, ci-après dénommée "convention", ou le protocole de 1998 à la convention sur la pollution atmosphérique transfrontière à longue distance de 1979, relatif aux polluants organiques persistants, ci-après dénommé "protocole", en réduisant si possible les rejets de telles substances en vue d'y mettre fin dès que possible et en édictant des règles relatives aux déchets qui sont constitués de ces substances, en contiennent ou sont contaminés par ce type de substances.
1. Taking into account, in particular, the precautionary principle, the objective of this Regulation is to protect human health and the environment from persistent organic pollutants by prohibiting, phasing out as soon as possible, or restricting the production, placing on the market and use of substances subject to the Stockholm Convention on Persistent Organic Pollutants, hereinafter "the Convention", or the 1998 Protocol to the 1979 Convention on Long-Range Transboundary Air Pollution on Persistent Organic Pollutants, hereinafter "the Protocol", and by minimising, with a view to eliminating where feasible as soon as possible, releases of such substances, and by establishing provisions regarding waste consisting of, containing or contaminated by any of these substances.

Ces actions qui répondent au souci de prévenir et de limiter les conséquences d'éventuels accidents doivent être complétées par d'autres initiatives visant à réduire, voire d'éliminer la possibilité de situations susceptibles d'évoluer vers un accident grave/.- 2 - C'est dans cette perspective que la Communauté veut déployer de nouveaux moyens pour contribuer à l'accroissement de la fiabilité des matériels.
The Commission has also decided, after more than 20 years, to resurrect its inspections of Member States' plants with the aim of checking the level of radioactivity in the atmosphere and whether the basic standards are being observed/.- 2 - The objective is to try to prevent and to limit any consequences of possible accidents, and these actions must run in harness with other initiatives aimed at reducing or, better still, eliminating the likelihood of situations which might develop into serious accidents. It is with this in mind that the Commission intends to look for new ways to help in improving the reliability of materials.
