Where the proprietor of an earlier national trade mark as referred to in Article 8(2) or of another earlier sign referred to in Article 8(4) has acquiesced, for a period of five successive years, in the use of a later European Union trade mark in the Member State in which the earlier trade mark or the other earlier sign is protected while being aware of such use, he shall no longer be entitled on the basis of the earlier trade mark or of the other earlier sign [...] to apply for a declaration that the later trade mark is invalid [...] in respect of the goods or services for which the later trade mark has been used, unless registration of the later European Union trade mark was applied for in bad faith'. ;

Furthermore, upon opposition by the proprietor of an earlier trade mark within the meaning of paragraph 2, or of an earlier Community or geographical indication, the trade mark applied for shall not be registered where it is identical with or similar to the earlier trade mark or geographical indication and is to be registered for goods or services which are not similar to those for which the earlier trade mark or geographical indication is registered, where, in the case of an earlier Community trade mark or geographical indication, the trade mark or geographical indication has a reputation in the Community and, in the case of an earlier national trade mark, the trade mark has a reputation in the Member State concerned and where the use without due cause of the trade mark applied for would take unfair advantage of, or be detrimental to, the distinctive character or the repute of the earlier trade mark or geographical indication ".
