In accordance with section III, paragraph 19, point (i) of the IGC 2007 Mandate relating to a Protocol on services of general interest which will be annexed to the Treaties, invites the Commission to take initiatives to overcome the legal uncertainty regarding the status of services of general interest, notably the state aid and public procurement rules; welcomes the initiatives of the Commission which aim to clarify ambiguities in the fields of health services and social services of general interest in the Single Market; considers that strong and modern services of general interest are necessary in order to achieve public interest objectives, such as social and territorial cohesion, environmental protection and cultural diversity;

In the view of the rapporteur, it is necessary to start to clarify the different concepts of public services and to distinguish between SGIs which are, on the one hand those of a commercial nature and mainly financed by the user, which the EC Treaty qualifies as services of general economic interest (SGEI) in line with Article 16 of the EU Treaty, and, on the other hand, those which are not of a commercial nature and are financed mainly by public or social funds, which may be regarded as services of non-economic general interest (SNEGI), such as services of general interest exercising exclusively social functions or prerogatives of public authorities.

The tax is not justified by any public interest objective and in any event is disproportionate to the aim, for instance, of preserving the aesthetic appearance of buildings: it is in fact applied irrespective of the size or appearance of the dish; whether it is visible of not; whether it is placed on a building or elsewhere -e.g. a garden-; whether the building is classified or not and without being assigned to improving the urban environment, etc.
