A. considérant que la Fédération de Russie, en tant que membre à part entière du Conseil de l'Europe et de l'Organisation pour la sécurité et la coopération en Europe (OSCE) et que signataire de la déclaration des Nations unies, s'est engagée à respecter les principes de la démocratie, de l'état de droit ainsi que les libertés fondamentales et les droits de l'homme; qu'en raison des nombreuses violations graves de l'état de droit et de l'adoption de lois restrictives ces derniers mois, de sérieux doutes sont émis sur l'intention de la Russie de se conformer à ses obligations nationales et internationales; que l'Union européenne a maintes fois proposé à la Russie une aide et une expertise supplémentaires, au moyen du partenariat pour la modernisation, pour l'aider à moderniser et à respecter son ordre constitutionnel et juridique, conformément aux normes du Conseil de l'Europe; qu'il existe un grand nombre d'affaires judiciaires dans lesquelles des motivations politiques inventées de toutes pièces sont invoquées pour se débarrasser d'adversaires politiques, menacer la société civile et dissuader les citoyens de prendre part à des manifestations et à des rassemblements publics hostiles aux dirigeants en place en Russie;
A. whereas the Russian Federation, as a full member of the Council of Europe and the Organisation for Security and Cooperation in Europe (OSCE) and a signatory to the UN declaration, has committed itself to the principles of democracy, the rule of law and respect for fundamental freedoms and human rights; whereas, as a result of numerous serious violations of the rule of law and the adoption of restrictive laws during the past months, there are grave concerns about to Russia’s compliance with international and national obligations; and whereas the EU has repeatedly offered additional assistance and expertise, through the Partnership for Modernisation, to help Russia to modernise and abide by its constitutional and legal order, in line with Council of Europe standards; whereas there are a multitude of judicial cases in which politically constructed reasons are used to eliminate political competition, threaten civil society and discourage citizens from participating in public rallies and protests opposing the country’s current leadership;

7. demande au gouvernement russe de prendre des mesures concrètes pour remédier à la détérioration de la situation des droits de l'homme, notamment en mettant fin à la campagne de harcèlement menée à l'encontre de militants et d'organisations de la société civile; demande à l'organe exécutif et au législateur de la Fédération de Russie de réexaminer et, le cas échéant, d'abroger les actes législatifs et les mesures récemment adoptés qui sont contraires aux engagements pris par la Russie en matière de droits de l'homme et de libertés fondamentales, en tant que membre du Conseil de l'Europe, et de tenir compte des propositions présentées par son médiateur chargé des droits de l'homme et par le Conseil des droits de l'homme au président de la Fédération de Russie;
7. Calls on the Russian Government to take concrete steps to address the deterioration of human rights, in particular by ceasing the campaign of harassment against civil-society organisations and activists; calls on the Russian executive and legislature to reconsider and eventually repeal recently adopted legislative acts and measures that are in conflict with the country’s stated commitments on human rights and fundamental freedoms as a member of the Council of Europe, and to take into account the proposals of its Human Rights Ombudsman and those of the Human Rights Council to the President of the Russian Federation;

Question No. 245 Hon. Irwin Cotler: With regard to the case of Sergei Magnitsky: (a) is the government preparing a list containing the names of any individual that it has reasonable grounds to believe (i) is responsible for the detention, abuse or death of Sergei Magnitsky, (ii) has conspired to defraud the Russian Federation of taxes on corporate profits through fraudulent transactions and lawsuits against the foreign investment company known as Hermitage and to misappropriate property owned or controlled by Hermitage, (iii) has participated in efforts to conceal the legal responsibility of those individuals involved in the detention, abuse or death of Sergei Magnitsky or the existence of the conspiracy referred to in point (ii); (b) if the government is preparing a list as per (a), does the list include the names of the 60 senior Russian officials included by the Commission on Security and Cooperation in Europe on its list entitled “Individuals involved in the tax fraud against Hermitage and the torture and death of Sergei Magnitsky”; (c) does the government plan to declare as ineligible for visas any foreign national whose name appears on the list referred to in (a), as well as the members of the foreign national’s immediate family; and (d) does the government plan to revoke the permanent or temporary resident status of any foreign national whose name appears on the list referred to in (a)?

9. invite instamment la Commission à établir une stratégie spécifique dans le cadre de sa proposition "Europe élargie" pour la démocratisation et l'instauration d'une économie sociale de marché en Biélorussie; estime que cette stratégie devrait être fondée sur les résultats positifs du programme TACIS, approuvé en ce qui concerne la Biélorussie par la décision 98/1/CE, Euratom du Conseil du 18 décembre 1997 relative à un programme TACIS de développement de la société civile en Biélorussie pour 1997 ; estime que cette stratégie devrait porter notamment sur les aspects suivants: renforcement et développement de différentes composantes de la société civile, y compris les syndicats et les fédérations patronales, aide au développement de médias libres et diversifiés, mesures visant à établir un système universitaire démocratique orienté vers l'Europe, et aide au développement d'un secteur stable de petites et moyennes entreprises compétitives; considère par ailleurs que cette stratégie devrait comporter des programmes de partenariat qui permettent aux membres de la société civile biélorusse de se former à la démocratie dans des pays européens voisins et de mettre à profit l'expérience ainsi acquise dans leur pays;
9. Strongly urges the Commission to develop a specific strategy within its "Wider Europe" proposal for democratisation and the development of a social market economy in Belarus; considers that this strategy should be based on positive results of the TACIS programme in Belarus, as approved by Council Decision 98/1/EC, Euratom of 18 December 1997 on a TACIS Civil Society Development Programme for Belarus in 1997 ; considers that this strategy should cover, in particular, the following matters: the strengthening and development of various forms of civil society, including trade unions and employers' federations, support for the development of free and diversified media, measures to establish a democratic, Europe-oriented university system and support for the development of a stable sector comprising small and medium-sized enterprises; considers, moreover, that this strategy should include partnership programmes enabling members of civil society in Belarus to gain experience of democracy in neighbouring European countries and to put to good use the experience thus acquired;
