(2) During the past years, Member States have notified an increasing number of new psychoactive substances via the mechanism for rapid exchange of information which was established by Joint Action 97/396/JHA of 16 June 1997 adopted by the Council on the basis of Article K.3 of the Treaty on European Union, concerning the information exchange, risk assessment and the control of new synthetic drugs[14] and was further strengthened by the Council Decision 2005/387/JHA of 10 May 2005 on the information exchange, risk-assessment and control of new psychoactive substances[15].

This decision establishes a mechanism for the rapid exchange of information on new psychoactive substances, an assessment of the risks by a scientific committee and a European procedure for placing the notified substances under control.

La présente décision ne devrait nullement empêcher les États membres d’échanger, dans le cadre du réseau européen d’information sur les drogues et les toxicomanies (Reitox), des informations sur les tendances émergentes en matière de nouvelles utilisations des substances psychoactives existantes susceptibles de représenter un danger pour la santé publique, ainsi que des informations sur les mesures de santé publique qui pourraient être prises, conformément au mandat et aux procédures de l’OEDT.
Nothing in this Decision should prevent Member States from exchanging information, within the European Information Network on Drugs and Drug Addiction (hereinafter ‘the Reitox network’), on emerging trends in new uses of existing psychoactive substances which may pose a potential risk to public health, as well as information on possible public health related measures, in accordance with the mandate and procedures of the EMCDDA.
