Reiterates that the Council ought to be transparent and fully accountable to Union citizens for the funds entrusted to it as a Union institution; stresses that this implies that the Council shall take part fully and in good faith in the annual discharge procedure, just as the other institutions do; considers, in this regard, that effective supervision of the Union's budget implementation requires cooperation between Parliament and the Council through a working arrangement; regrets the difficulties encountered in the discharge procedures to date; takes note, nonetheless, of the interest shown by the current Presidency of the Union in reconciling positions, as well as of the letter from the Secretary General of the Council in response to questions tabled by the Committee on Budgetary Control in which he expresses his willingness to support actively tangible measures to reach a ʽmodus vivendiʼ as called for by Parliament in its resolution of 23 October 2014 ; stresses the need to improve the capacity for dialogue between the two institutions in order to find a solution as soon as possible that will enable compliance with the Treaty mandate and accountability to citizens;

Un tel encadrement minimum pourrait régler certains des aspects suivants : les conditions d'accès à cette peine; leur durée, éventuellement en fixant un minimum et/ou un maximum ; les conditions à imposer pour leur mise en oeuvre ; la nature du travail à exécuter qui, comme les modalités d'exécution du travail d'intérêt général, devraient éventuellement varier en fonction du délit commis (p.ex. un travail à l'hôpital pour un délinquant qui a causé des lésions corporelles importantes ou un travail dans une maison de repos pour un jeune délinquant qui a agressé des personnes âgées) ; les conditions de contrôle de ces peines alternatives ainsi que les sanctions en cas de non-respect des conditions imposées pour leur mise en oeuvre.
A minimal approach would be to regulate the following aspects: conditions in which these penalties may be imposed; duration of the penalty, with a possible indication of a minimum and/or a maximum period; conditions of implementation; the nature of the work to be done which, like the practical arrangements for community service, may differ according to the offence committed (for example hospital work for a person who has caused grievous bodily harm or work in old people's home for a young person who has attacked an elderly person); monitoring of alternative sanctions; penalties for failure to respect the conditions imposed for their implementation and, finally, as regards probation, the consequences of not abiding by the conditions set.

En ce qui concerne le travail d'intérêt général, la question se pose de savoir s'il convient de prévoir, au niveau de l'Union européenne, un rapprochement de certaines conditions d'octroi et modalités d'application de cette peine alternative, afin de faciliter sa reconnaissance et exécution dans un autre Etat membre.
As regards community service, the question is whether there should be harmonisation at European Union level of the conditions under which such alternative sanctions are imposed and the practical arrangements for implementation, to facilitate recognition and implementation in other Member States.

À cette fin, le directeur exécutif devrait élaborer une proposition de programme de travail pour l'Agence, après consultation préalable de la Commission et du groupe permanent des parties prenantes, et arrêter toutes les mesures nécessaires pour garantir la bonne exécution du programme de travail de l'Agence, préparer chaque année un projet de rapport général à soumettre au conseil d'administration, établir un projet d'état prévisionnel des recettes et des dépenses de l'Agence et exécuter le budget.
To this end, the Executive Director should prepare a proposal for the Agency's work programme, after prior consultation of the Commission and of the Permanent Stakeholders' Group, and take all necessary steps to ensure the proper accomplishment of the working programme of the Agency, should prepare each year a draft general report to be submitted to the Management Board, should draw up a draft statement of estimates of revenue and expenditure of the Agency and should implement the budget.
