TRADUCTIONS EN CONTEXTE

Afin de garantir l’application des règles nécessaires au bon fonctionnement de l’identification, de l’enregistrement et de la traçabilité des bovins et de la viande bovine, il convient de déléguer à la Commission le pouvoir d’adopter des actes délégués conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne, en ce qui concerne les exigences relatives à des moyens alternatifs pour l’identification des bovins, les circonstances particulières dans lesquelles les États membres sont autorisés à prolonger le délai maximal prévu pour l’application des moyens d’identification, les données à échanger entre les bases de données informatisées des États membres, le délai maximal prévu pour certaines obligations de notification, les exigences applicables aux moyens d’identification, l’ajout de moyens d’identification à la liste figurant à l’annexe I, les règles concernant les informations provenant des bases de données informatisées qui doivent figurer dans les passeports des animaux et dans les registres individuels qui doivent être tenus dans chaque exploitation, l’identification et l’enregistrement des mouvements de bovins mis à pâturer à titre saisonnier, y compris lors d’une transhumance, les règles d’étiquetage de certains produits, lesquelles devraient être équivalentes à celles fixées dans le règlement (CE) no 1760/2000, les dispositions régissant l’étiquetage relatives à une présentation simplifiée de l’indication de l’origine dans les cas où l’animal n’est présent que très brièvement dans l’État membre ou le pays tiers de naissance ou d’abattage, ainsi que les définitions et les exigences applicables aux termes ou catégories de termes pouvant figurer sur les étiquettes de viande de bœuf ou de veau préemballée, fraîche ou congelée.
In order to ensure that the necessary rules for the proper functioning of the identification, registration and traceability of bovine animals and of beef are applied, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the requirements for alternative means of identification of bovine animals; the special circumstances in which Member States are to be permitted to extend the maximum periods for the application of the means of identification; data to be exchanged between the computerised databases of the Member States; the maximum period for certain reporting obligations; the requirements for the means of identification; the addition of means of identification to the list set out in Annex I; the rules concerning the information from the computerised database to be included in the animal passports and in the individual registers to be kept on each holding; the identification and registration of movements of bovine animals when put out to seasonal grazing including transhumance; rules for labelling certain products which should be equivalent to the rules laid down in Regulation (EC) No 1760/2000; the labelling provisions relating to a simplified presentation of the indication of origin for cases of very short stay of an animal in the Member State or third country of birth or of slaughter; and the definitions and requirements applicable to terms or categories of terms that may be put on the labels of pre-packed fresh and frozen beef and veal.

3. Afin de garantir une traçabilité adéquate, une bonne adaptabilité au progrès technique et le fonctionnement optimal du système d’identification, la Commission adopte des actes délégués en conformité avec l’article 22 ter en ce qui concerne les exigences relatives aux moyens d’identification énoncés à l’annexe I et les mesures transitoires nécessaires pour l’instauration de moyens d’identification particuliers.
3. To ensure adequate traceability and adaptability to technical progress and optimal functioning of the identification system, the Commission shall adopt delegated acts in accordance with Article 22b concerning the requirements for the means of identification set out in Annex I, and the transitional measures required for the introduction of a particular means of identification.

(22) In order to ensure that the necessary rules for the proper functioning of the identification, registration and traceability of bovine animals and beef are applied, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of requirements for alternative means of identification of bovine animals, special circumstances in which Member States may extend the maximum periods for the application of the means of identification, data to be exchanged between the computerised databases of the Member States, the maximum period for certain reporting obligations, the requirements for means of identification, the information to be included in the passports and in the individual registers to be kept on each holding, the minimum level of official controls, the identification and registration of movements of bovine animals when put out to summer grazing in different mountain areas , rules for labelling certain products which should be equivalent to the rules laid down in Regulation (EC) No 1760/2000, the definitions of minced beef, beef trimmings or cut beef, the specific indications that may be put on labels, the labelling provisions related to the simplification of the indication of origin, the maximum size and composition of certain groups of animals, the approval procedures related to labelling conditions on packaging of cut meat and the administrative sanctions to be applied by the Member States in cases of non-compliance with Regulation (EC) No 1760/2000.

(37)(27) Lorsque, conformément à la législation communautaire et notamment à la directive 2002/47/CE du Parlement européen et du Conseil du 6 juin 2002 concernant les contrats de garantie financière[35] un client transfère la pleine propriété d’instruments financiers ou de fonds à une entreprise d’investissement à titre de sûretés d’obligations présentes ou futures, qu’elles soient réelles, conditionnelles ou potentielles, ou en vue de les garantir d’une autre manière, il y a également lieu de considérer que ces instruments ou fonds ne devraient plus appartenir au client.ð Les exigences relatives à la protection des actifs des clients sont un outil indispensable pour la protection de ces derniers dans le cadre de la fourniture de services ou d’activités.
(37)(27) Where a client, in line with Community legislation and in particular Directive 2002/47/EC of the European Parliament and of the Council of 6 June 2002 on financial collateral arrangements[35], transfers full ownership of financial instruments or funds to an investment firm for the purpose of securing or otherwise covering present or future, actual or contingent or prospective obligations, such financial instruments or funds should likewise no longer be regarded as belonging to the client.ð The requirements concerning the protection of client assets are a crucial tool for the protection of clients in the provision of services and activities.

3. 3. Where the applicable law imposes formal requirements on the authorisation of a shareholder referred to in paragraph 1 to exercise voting rights, or on voting instructions, such formal requirements shall not go beyond what is necessary to ensure the identification of the client, or the possibility of verifying the content of voting instructions, respectively, and is proportionate to achieving those objectives.
