Une autre question liée à celle des droits des citoyens, tels que reconnus par la Charte, a été soulevée par un très grand nombre de personnes qui affirment que l'agence chargée de la protection de l'enfance en Allemagne – le Jugendamt – prend en fait des décisions beaucoup trop arbitraires et discriminatoires, très souvent au détriment de l'enfant, à la suite de la séparation ou du divorce des parents de nationalités différentes – le parent de nationalité allemande obtenant une décision à son avantage, et l'autre, ressortissant d'un autre pays, tel que la Pologne, la France, la Belgique, apparaissant dans une position de victime.
Another issue related to the question of the rights of the citizen as contained in the Charter has been raised by a very large number of people who allege that the German child protection agency - the Jugendamt, in fact takes too many arbitrary and discriminatory decisions to the detriment of the child in many cases, following the separation or divorce of their bi-national parents - one being from Germany who obtains advantage, the other being from a third country such as Poland, France, Belgium who appears to be the victim.

- having regard to the 2000 Palermo Protocol to prevent, suppress and punish trafficking in persons, especially women and children, supplementing the United Nation convention against transnational organized crime, annexed to the UN Convention against Transnational Organised Crime in which trafficking in human beings is defined as: the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation.

Les décisions rendues avant la date de mise en application du présent règlement à la suite d'actions intentées après la date d'entrée en vigueur du règlement (CE) n° 1347/2000 sont reconnues et exécutées conformément aux dispositions du chapitre III du présent règlement pour autant qu'il s'agisse d'une décision de divorce, de séparation de corps ou d'annulation du mariage, ou d'une décision relative à la responsabilité parentale des enfants communs rendue à l'occasion d'une telle action matrimoniale.
3. Judgments given before the date of application of this Regulation in proceedings instituted after the entry into force of Regulation (EC) No 1347/2000 shall be recognised and enforced in accordance with the provisions of Chapter III of this Regulation provided they relate to divorce, legal separation or marriage annulment or parental responsibility for the children of both spouses on the occasion of these matrimonial proceedings.

4. Les décisions rendues avant la date de mise en application du présent règlement, mais après la date d'entrée en vigueur du règlement (CE) n° 1347/2000, à la suite d'actions intentées avant la date d'entrée en vigueur du règlement (CE) n° 1347/2000 sont reconnues et exécutées conformément aux dispositions du chapitre III du présent règlement pour autant qu'il s'agisse d'une décision de divorce, de séparation de corps ou d'annulation du mariage, ou d'une décision relative à la responsabilité parentale des enfants communs rendue à l'occasion d'une telle action matrimoniale, et que les règles de compétence appliquées sont conformes à celles prévues soit par le chapitre II du présent règlement ou du règlement (CE) n° 1347/2000, soit par une convention qui était en vigueur entre l'État membre d'origine et l'État membre requis lorsque l'action a été intentée.
4. Judgments given before the date of application of this Regulation but after the date of entry into force of Regulation (EC) No 1347/2000 in proceedings instituted before the date of entry into force of Regulation (EC) No 1347/2000 shall be recognised and enforced in accordance with the provisions of Chapter III of this Regulation provided they relate to divorce, legal separation or marriage annulment or parental responsibility for the children of both spouses on the occasion of these matrimonial proceedings and that jurisdiction was founded on rules which accorded with those provided for either in Chapter II of this Regulation or in Regulation (EC) No 1347/2000 or in a convention concluded between the Member State of origin and the Member State addressed which was in force when the proceedings were instituted.
