For a food or feed product containing GMOs or consisting of such organisms, the applicant has a choice: either file the application exclusively under Regulation 1829/2003 pursuant to the "one door, one key" principle in order to obtain an authorisation for the deliberate release of a GMO into the environment — in accordance with the criteria established by Directive 2001/18/EC — and the authorisation to use this GMO in food and feed — in accordance with the criteria established by Regulation 1829/2003.; Or, the applicant can choose to split the application, and submit it both under Directive 2001/18/EC and Regulation 1829/2003.

Thus, it is possible to file a single application for obtaining both the authorisation for the deliberate release of a GMO into the environment, under the criteria laid down in Directive 2001/18/EC and the authorisation for use of this GMO in food and/or feed under the criteria laid down in Regulation 1829/2003.

(33) Lorsque la demande porte sur des produits contenant des OGM ou consistant en de tels organismes, le demandeur devrait pouvoir choisir soit de présenter une autorisation de dissémination volontaire dans l'environnement qu'il a déjà obtenue au titre de la partie C de la directive 2001/18/CE - sans préjudice des conditions fixées par cette autorisation - soit de demander que l'évaluation des risques pour l'environnement soit effectuée en même temps que l'évaluation de la sécurité prévue par le présent règlement.
(33) Where the application concerns products containing or consisting of a genetically modified organism, the applicant should have the choice of either supplying an authorisation for the deliberate release into the environment already obtained under part C of Directive 2001/18/EC, without prejudice to the conditions set by that authorisation, or of applying for the environmental risk assessment to be carried out at the same time as the safety assessment under this Regulation.

Le présent paragraphe ne s'applique pas aux décisions concernant la dissémination volontaire, conformément à la partie B de la directive 2001/18/CE, d'un OGM qui n'est pas destiné à être utilisé directement pour l'alimentation humaine ou animale ou à être transformé, dans un pays tiers sans décision ultérieure.
This paragraph shall not apply to decisions regarding the deliberate release in accordance with Part B of Directive 2001/18/EC of a GMO which is not intended for direct use as food or feed or for processing in a third country without a subsequent decision.
