Elle soutient que le Tribunal de l’Union européenne a commis une erreur de droit en soulevant d’office l’exception d’irrecevabilité du recours introduit par la requérante dans l’affaire T-438/10, sans exposer les raisons de fait et de droit sur lesquelles est fondée ladite exception et sans permettre aux parties de se prononcer à cet égard, comme le prévoit l’article 113 du règlement de procédure du Tribunal.
It submits that the General Court erred in law in so far as it raised an objection of inadmissibility of its own motion in respect of the action brought by Forgital Italy in Case T-438/10 without setting out the reasons of fact and law on which that objection was based or allowing the parties to submit their comments in that regard, as required under Article 113 of the Rules of Procedure of the General Court.

Pleas in law: Infringement of Rule 50(1) of Commission Regulation No 2868/95 and Articles 76, 8 and 8(2)(c) of Council Regulation No 207/2009, as the Board of Appeal: (i) has neglected its right to examine the facts of its own motion, and take into consideration facts that are apparently likely to affect the outcome of the opposition; (ii) erred in law when it did not consider that ‘Pierre Robert’ is a well known mark; (iii) failed when not considering the evidence, Annex 1, which was submitted in connection with the filing of the opposition; and (iv) failed when not accepting the certificate from the Swedish Patent and Registration Office filed before the decision of the opposition division.

[Right to Refuse] The Office of any designated Contracting Party may, where the conditions for the grant of protection under the law of that Contracting Party are not met in respect of any or all of the industrial designs that are the subject of an international registration, refuse the effects, in part or in whole, of the international registration in the territory of the said Contracting Party, provided that no Office may refuse the effects, in part or in whole, of any international registration on the ground that requirements relating to the form or contents of the international application that are provided for in this Act or the Regulations or are additional to, or different from, those requirements have not been satisfied under the law of the Contracting Party concerned.
