Where an international treaty has implications for provincial and territorial governments, as is the case with the Convention on the Rights of Persons with Disabilities, CRPD, e.g., regarding accessibility of buildings and services, legal capacity, health, education, family law, et cetera, these governments will do their own assessments to ensure conformity with the relevant provisions of the treaty.

(2) En vue d’une mise en œuvre efficace des dispositions pertinentes du Traité d’Amsterdam, le Conseil Justice et Affaires intérieures a, le 3 décembre 1998, adopté un plan d’action concernant les modalités optimales de mise en œuvre des dispositions du Traité d’Amsterdam relatives à l’établissement d’un espace de liberté, de sécurité et de justice précisant l’importance de la compatibilité des règles de conflit de lois pour la réalisation de l’objectif de la reconnaissance mutuelle des décisions judiciaires et invité à la révision, si nécessaire, de certaines dispositions de la convention sur la loi applicable aux obligations contractuelles, compte tenu des dispositions spéciales sur les règles relatives au conflits de lois figurant dans les autres instruments communautaires.
(2) For the purposes of effectively implementing the relevant provisions of the Amsterdam Treaty, the Council (Justice and Home Affairs) on 3 December 1998 adopted a plan of action on how best to implement the provisions of the Treaty of Amsterdam on an area of freedom, security and justice, stressing the importance of promoting the compatibility of conflict-of-law rules in order to attain the objective of mutual recognition of judgments and calling for the revision, where necessary, of certain provisions of the Convention on the Law applicable to contractual obligations, taking into account special provisions on conflict-of-law rules in other Community instruments.

The Commission considers that these agreements may fall within the European Union definition of a "concession" in which case they should be subject either to the relevant provisions of the works procurement Directive (93/37/EEC) or, when they are concerned with provision of services, to the relevant provisions of the EC Treaty (in particular Article 49).

Article 7a Notwithstanding Article 7(2), this Regulation shall not affect Member States' obligations deriving from the Schengen agreements and related agreements or rules adopted on the basis of those agreements, as defined in Annex A to Council Decision 1999/435/EC concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis( ).

In addition, the Committee on Institutional Affairs could emphasise how difficult it is to interpret the Protocol, which stipulates that, if the decision on classification is not taken in time, the provisions which constitute the Schengen acquis shall continue to come under the third pillar (Article 2(1), fourth subparagraph). However, it also states that proposals and initiatives to build upon the Schengen acquis shall be subject to the relevant provisions of the Treaties (Article 5(1), first subparagraph).
