(1) Subject to his liability to carry out all his obligations under the contract of carriage, the consignor has the right to dispose of the cargo by withdrawing it at the aerodrome of departure or destination, or by stopping it in the course of the journey on any landing, or by calling for it to be delivered at the place of destination or in the course of the journey to a person other than the consignee named in the air waybill, or by requiring it to be returned to the aerodrome of departure. He must not exercise this right of disposition in such a way as to prejudice the carrier or other consignors and he must repay any expenses occasioned by the exercise of this right.

Pour déterminer s'il y a eu violation d'un droit de propriété intellectuelle au regard du droit interne de l'État membre, et conformément aux dispositions nationales relatives à la protection des données à caractère personnel, du secret commercial et industriel ainsi que du secret professionnel et administratif, le bureau de douane ou le service qui a traité la demande communique au titulaire du droit, à sa demande et si elles sont connues, les coordonnées du destinataire, de l'expéditeur, du déclarant ou du détenteur des marchandises, l'origine et la provenance des marchandises soupçonnées de porter atteinte à un droit de propriété intellectuelle.
3. With a view to establishing whether an intellectual property right has been infringed under national law, and in accordance with national provisions on the protection of personal data, commercial and industrial secrecy and professional and administrative confidentiality, the customs office or department which processed the application shall inform the right-holder, at his request and if known, of the names and addresses of the consignee, the consignor, the declarant or the holder of the goods and the origin and provenance of goods suspected of infringing an intellectual property right.
