The contracting entity shall take into consideration explanations which are justified on objective grounds relating to the economics of the construction or production method, or the technical solutions chosen, or the exceptionally favourable conditions available to the tenderer for the execution of the contract, or the originality of the product or the work proposed by the tenderer, as well as relating to the compliance with the employment protection provisions and working conditions, collective as well as individual rights, towards workers and labour law obligations towards their representatives according to Article 38, by the tenderer and subcontractors in the execution of the contract, including - in the case of supply of goods and services originating from third countries - the compliance with internationally agreed labour standards as defined in Annex XXIV.
