19. se félicite du fait que, après que l'ancien chef du service juridique eut quitté l'Agence en juin 2012 pour rejoindre en tant que conseiller principal un cabinet d'avocats aux États-Unis ayant un certain nombre de sociétés de l'industrie pharmaceutique comme clients, le directeur exécutif de l'Agence ait entrepris un examen de son travail en tant que chef du service juridique, président du comité mixte, président du comité disciplinaire et membre de la commission consultative des achats et des marchés; reconnaît qu'aucune preuve de conflit d'intérêt ou de violation des obligations prévues aux articles 11 et 11 bis du statut n'a pu être relevée; se félicite du fait que, conformément à l'article 16 du statut, le directeur exécutif ait imposé des restrictions aux activités de l'ancien chef du service juridique pour une période de deux ans à compter de son départ de l'Agence; demande à l'Agence de fournir à l'autorité de décharge des informations détaillées sur ces restrictions;

Welcomes the fact that after the former Head of the Legal Service left the Agency in June 2012 to join a US-based law firm having a number of pharmaceutical industry companies as clients as senior counsel, the Executive Director of the Agency launched a review of his work as Head of the Legal Service, Chair of the Joint Committee, Chair of the Disciplinary Committee and as a member of the Advisory Committee on Procurement and Contracts; acknowledges that no evidence of conflicts of interest nor breach of obligations provided in Articles 11 and 11a of the Staff Regulations could be identified; welcomes the fact that in accordance with Article 16 of the Staff Regulations, the Executive Director imposed some restrictions to the activities of the former Head of Legal Service for a period of two years following his leaving the Agency; calls on the Agency to provide the discharge authority with detailed information on those restrictions;

There are no detailed rules on the practical organisation of the arbitration phase, e.g. which competent authority takes the initiative to establish the advisory commission, where does the advisory commission meet, who provides the facilities for a secretariat, when is a case considered as being referred to the advisory commission, what is the level of fees of the Members and Chairman, what will be the content of the opinion and what are the conditions for its publication, etc.
