Recognises the comments made by the Court of Auditors which focus on the legality and regularity of transactions, on the internal controls and on budgetary management; is at the same time also aware of the Centre's reply; welcomes that the Centre itself has informed the Court in October 2011 regarding the exceedance of the payment ceiling of the framework contract and seeking advice and guidance in this matter with the spirit of full transparency; considers the immediate measures taken by the Centre as appropriate in terms of business continuity as well as corrective actions; takes note that no funds were lost and no parties were damaged; notes that the Centre has revised its grant verification policy in order to ensure the eligibility and accuracy of the costs claimed; is aware of the multi-annual activities of the Centre which caused carry-overs of EUR 8.3 million; asks nevertheless the Centre to respect the annuality principle of the budget;

Is concerned about the fact that once again the Centre has not comprehensively fulfilled its obligation to send to the discharge authority a report drawn up by its Director summarising the content of the Internal Audit Service (IAS) recommendation as provided for in Article 72(5) of the framework Financial Regulation; is concerned, in particular, that, in relation to the follow-up of earlier recommendations, the Centre received one ‘very important’ recommendation and seven other ‘important’ recommendations from the IAS but that no information is given on their content; urges therefore the Director of the Centre to provide this information;

The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in respect of technical adjustments to Directive 2006/48/EC to clarify definitions to ensure uniform application of that Directive or to take account of developments on financial markets; to align terminology on, and frame definitions in accordance with, subsequent relevant acts; to expand the content or adapt the terminology of the list of activities subject to mutual recognition under that Directive to take account of developments on financial markets; to adjust the areas in which the competent authorities are required to exchange information; to adjust the provisions of that Directive on own funds to reflect developments in accounting standards or Union legislation, or with regard to the convergence of supervisory practices; to expand the lists of exposure classes for the purposes of the Standardised Approach or the IRB Approach to take account of developments on financial markets; to adjust certain amounts relevant to those exposure classes to take into account the effects of inflation; to adjust the list and classification of off-balance sheet items; and to adjust specific provisions and technical criteria on the treatment of counterparty credit risk, the organisation and treatment of risk, the Standardised Approach and the IRB Approach, credit risk mitigation, securitisation, operational risk, review and evaluation by the competent authorities and disclosure in order to take account of developments on financial markets or in accounting standards or Union legislation, or with regard to the convergence of supervisory practices.

Deplores the fact that the Centre has not comprehensively fulfilled its obligation to send to the authority responsible for discharge a report drawn up by its Director summarising the number of internal audits conducted by the internal auditor as provided for in Article 72(5) of the framework Financial Regulation; acknowledges, nevertheless, that the Centre gave some information on the six recommendations still open, which are considered to be ‘very important’ by the Commission's Internal Audit Service; notes that these affect the quality of management (as regards scientific advice, health communication and strengthening the current procedure for urgent risk/threat assessment), follow-up action in respect of certain internal control standards (such as the setting-up of financial circuits) and the implementation of other internal control standards (such as identifying weaknesses and structuring the annual Activity Report);
