Si, à la date de première application des amendements introduits par Entités d’investissement (laquelle correspond, aux fins de la présente norme, à la date d’ouverture de l’exercice pour lequel l’entité applique ces amendements pour la première fois), une société mère conclut qu’elle est une entité d’investissement, elle doit appliquer les paragraphes 18C à 18I à sa participation dans une filiale.
If, at the date of initial application of the Investment Entities amendments (which, for the purposes of this IFRS, is the beginning of the annual reporting period for which those amendments are applied for the first time), a parent concludes that it is an investment entity, it shall apply paragraphs 18C–18I to its investment in a subsidiary.

BW. whereas, despite the fact that the laws were amended in 2011 following negotiations with the European Commission and in May 2012 further to the decision of the Constitutional Court of December 2011 overturning several provisions as unconstitutional regarding the content regulation of the printed press, the protection of the sources of journalists, the requirement of data provision, and the institution of the Media and Telecommunications Commissioner, the OSCE Representative on freedom of the Media has deplored the fact that several amendments were introduced and adopted at short notice without consulting stakeholders and that fundamental elements in the legislation have not been improved, notably the appointment of the president and members of the Media Authority and Media Council, their power over content in the broadcast media, the imposition of high fines and the lack of safeguards on the financial and editorial independence of public broadcasters;

Afin de mettre en place des pratiques d’exécution cohérentes, efficientes et efficaces et de veiller à l’application commune, uniforme et cohérente du présent règlement, le CRU émet, à l’intention des autorités nationales de résolution, des orientations concernant l’application des amendes et des astreintes.
4. The Board shall, with a view to establishing consistent, efficient and effective enforcement practices, and to ensuring the common, uniform and consistent application of this Regulation, issue guidelines on the application of fines and periodic penalty payments addressed to the national resolution authorities.

Afin de garantir des pratiques d’exécution cohérentes, efficientes et efficaces, le CRU devrait être habilité à émettre des orientations, à l’intention des autorités nationales de résolution, concernant l’application des amendes et des astreintes.
In order to ensure consistent, efficient and effective enforcement practices the Board should be entitled to issue guidelines addressed to national resolution authorities concerning the application of fines and penalty payments.

(11) La procédure d'application des amendes aux États membres qui ne prennent pas de mesures suivies d'effets en vue de corriger leurs déséquilibres macroéconomiques devrait être interprétée de telle sorte que l'application de l'amende à ces États membres serait équitable et efficace.
(11) The procedure for the application of the fines on the Member States which fail to take effective measures to correct macroeconomic imbalances should be construed in such a way that the application of the fine on those Member States would be fair and efficient.

(11) La procédure d'application des amendes aux États membres qui ne prennent pas de mesures suivies d'effets en vue de corriger leurs déséquilibres macroéconomiques devrait être interprétée de telle sorte que l'application de l'amende à ces États membres serait la règle et non l'exception.
(11) The procedure for the application of the fines on the Member States which fail to take effective measures to correct macroeconomic imbalances should be construed in such a way that the application of the fine on those Member States would be the rule and not the exception.

Si une entité a précédemment appliqué cette interprétation sans avoir appliqué les amendements, elle doit comptabiliser l’ajustement résultant de l’application des amendements en résultats non distribués au début de la première période présentée à titre comparatif.
If the entity had previously applied this Interpretation before it applies the amendments, it shall recognise the adjustment resulting from the application of the amendments in retained earnings at the beginning of the earliest comparative period presented.

Where the product continues not to be in conformity for more than one month, the Member State shall take all necessary measures pursuant to Article 7 to restrict or prohibit the placing on the market of the product in question or to ensure that it is withdrawn from the market, subject to penalties if not, to be decided by the Member State.
