In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission in respect of setting out the annual breakdown, by Member State, of the global resources available for commitments in the framework of shared management approving the operational programmes and their amendments, approving the work plans for data collection, adopting the annual work programmes relating to technical assistance at the initiative of the Commission, recognising that there is evidence suggesting non-compliance with obligations under the CFP, recognising that a Member State has failed to comply with its obligations under the CFP, suspending all or part of the interim payments under the operational programme and making financial corrections by cancelling all or part of the Union support for an operational programme.

(3) Where the Commission rescinds approval of a plan pursuant to subsection (1), it shall include in the notice referred to therein a statement of its reasons therefor.

49 (1) The Minister may at any time, and shall on request of the applicant, revoke any approval of an application given pursuant to subsection 48(3) and, where the Minister does so, he shall send to the applicant a notice in writing of the revocation setting out the date on and after which the revocation is effective.

1 Par sa requête, la Commission des Communautés européennes demande l’annulation de la décision 2003/106/CE du Conseil, du 19 décembre 2002, concernant l’approbation, au nom de la Communauté européenne, de la convention de Rotterdam sur la procédure de consentement préalable en connaissance de cause applicable à certains produits chimiques et pesticides dangereux qui font l’objet d’un commerce international (JO 2003, L 63, p. 27, ci-après la «décision attaquée»), dans la mesure où elle est fondée sur l’article 175, paragraphe 1, CE et non sur l’article 133 CE.
By its application, the Commission of the European Communities seeks the annulment of Council Decision 2003/106/EC of 19 December 2002 concerning the approval, on behalf of the European Community, of the Rotterdam Convention on the Prior Informed Consent Procedure for certain hazardous chemicals and pesticides in international trade (OJ 2003 L 63, p. 27, ‘the contested decision’), in so far as it is based on Article 175(1) EC and not on Article 133 EC.
