This Regulation lays down certain procedures for the adoption of detailed rules for the implementation of certain provisions of the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Bosnia and Herzegovina, of the other part (‘SAA’), and of the Interim Agreement on trade and trade-related matters between the European Community, of the one part, and Bosnia and Herzegovina, of the other part (‘Interim Agreement’).

Where exceptional and critical circumstances arise within the meaning of Article 25(4)(b) and Article 26(4) of the Interim Agreement, and thereafter Article 38(4)(b) and Article 39(4) of the Stabilisation and Association Agreement, the Commission may take immediate measures as provided for in Articles 25 and 26 of the Interim Agreement, and thereafter Articles 38 and 39 of the Stabilisation and Association Agreement, in accordance with the examination procedure referred to in Article 7fa(4) of this Regulation, or in cases of urgency, in accordance with Article 7fa(5) of this Regulation.

In the case of a practice that may justify application by the Union of the measures provided for in Article 33 of the Interim Agreement, and thereafter Article 69 of the Stabilisation and Association Agreement, the Commission, after examining the case, on its own initiative or at the request of a Member State, shall decide whether such practice is compatible with the Agreement.

Notwithstanding Articles 5 and 6, where the Union needs to take a safeguard measure concerning agricultural and fishery products, as provided for in Article 17(2) or Article 26 of the Interim Agreement, and thereafter in Article 32(2) or Article 41 of the SAA, the Commission shall, at the request of a Member State or on its own initiative, adopt the necessary measures, where applicable after referring the matter to the Interim Committee pursuant to Article 26(5)(a) of the Interim Agreement, and thereafter to the Stabilisation and Association Council pursuant to Article 41(5)(a) of the SAA.
