Notes that on the basis of the agencies’ contribution, the Commission elaborated guidelines with standard provisions for headquarter agreements between decentralised agencies and host Member States; notes with concern that 10 agencies still do not have a headquarter agreement; exhorts these agencies to tackle the issue of headquarter agreements effectively and as a priority in order to increase efficiency and save costs; expresses concern that the lack of headquarter agreements may have serious implications for the staff of the agencies and calls on the Member States to complete the agreements before the start of the next discharge procedure;

Notes that the negotiations between the EU and Switzerland have led to an agreement regarding the amending of Annex III of the Agreement between the European Community and its Member States, of the one part, and the Swiss Confederation, of the other, on the free movement of persons so as to include Directive 2005/36/EC; notes that the agreement foresees a provisional application of most of the Directive, with the exception of Title II, which requires adaptations in Switzerland, and that the Council Decision regarding the abovementioned agreement will lapse if the Swiss fail to notify the completion of their internal procedures for the implementation of the Decision within 24 months of the adoption of the decision; is committed to following developments on this issue closely;

Observes that, pursuant to Article 6 of the Directive, the majority of Member States have a procedure for giving the mediation settlement agreement the same authority as a judicial decision; notes that this is achieved either by submitting it to the court or by having the agreement notarised, and that it appears that some national legislatures have opted for the former solution, while, by contrast, in many Member States notarisation is also an available option under national law: for instance, whereas in Greece and Slovenia the law provides that a mediation agreement record may be enforced by the courts, in the Netherlands and in Germany agreements can be rendered enforceable as notarial acts, and in other Member States, including Austria, they can, as the law currently stands, be rendered enforceable as notarial acts despite the lack of any explicit provision to that effect in the relevant national legislation; calls on the Commission to ensure that all Member States that do not yet comply with Article 6 of the Directive do so without delay;

MIDDLE EAST - PEACE PROCESS - Council conclusions "The Council of the European Union: - aware of the historic importance of the Interim Agreement signed between Israel and the PLO on 28 September 1995; - convinced that it is necessary to contribute towards the success of that Agreement, and that economic and social development is a key factor for achieving just and lasting peace; - resolved to strengthen cooperation by the Union, as the leading donor, with the Territories covered by the peace agreements; - convinced that the peoples in the region must be the prime beneficiaries of peace, 1. invites the Commission to begin exploratory talks with the Palestinian Authority with a view to the conclusion of a Euro- Mediterranean Association Agreement as soon as circumstances permit; 2. restates its desire to conclude as soon as possible the Euro- Mediterranean Association Agreements which the Commission is in the process of negotiating with the countries of the region; 3. invites the Commission to take the necessary measures to enable the Territories covered by the peace agreements to benefit from increased aid in accordance with the conclusions of the Cannes European Council; 4. calls upon the European Investment Bank to speed up the commitment, at the earliest opportunity, of ECU 250 million in the form of appropriations for projects to develop the Territories covered by the peace agreements; 5. confirms that there will be observation of the elections to the Palestinian Council and that the international operation for observing these elections will be coordinated.

DRAFT COMMISSION DIRECTIVES ON - MOBILE AND PERSONAL COMMUNICATIONS - IMPLEMENTATION OF FULL COMPETITION IN TELECOMMUNICATIONS MARKETS The Council held a wide-ranging exchange of views on the above draft Directives based on Article 90(3) of the Treaty; it then adopted the following conclusions: "The COUNCIL - NOTES that the Commission requested, on 3 August 1995, any comments from the Council on the draft Commission Directive amending Directive 90/388/EEC as regards mobile and personal communications; sent the President-in-Office of the Council, on 29 September 1995, the draft Commission Directive amending Directive 90/388/EEC as regards the implementation of full competition in telecommunications markets; - NOTES also the public consultation launched by the Commission following the publication of the two draft Directives in the Official Journal of the European Communities; - REAFFIRMS that it is important that the conditions governing the definition of the Community's future policy on the liberalization of telecommunications services and infrastructures should result from a political agreement based on the compromise of December 1989 and takes note of the Commission's support for this approach; - RECALLS in this connection the political agreement reached at the Telecommunications Council meeting on 17 November 1994, which was given concrete form in the Council Resolution of 22 December 1994 and in the statements made on that occasion; RECALLS that this Resolution recognizes in particular the principle of liberalization of telecommunication infrastructures on 1 January 1998, on the understanding that an additional transitional period is granted to certain Member States; - POINTS OUT that the Commission must also take account in its approach of the responsibilities of the European Parliament and the Council for the legislative provisions designed, on the basis of Commission proposals, to establish the European regulatory framework for telecommunications, parti ...
