10 (1) The Minister shall consult with relevant federal and provincial ministers and agencies, with affected coastal communities, aboriginal organizations, aboriginal governments and bodies established under land claims agreements, and with other persons and bodies that the Minister considers appropriate in the development of marine conservation area policy and regulations, the establishment of any proposed marine conservation area and the modification of any marine conservation area, and any other matters that the Minister considers appropriate.

He has called upon the Commission to provide a comprehensive annual report on the implementation of the Agreement - together with the Protocol and the Annexes, which form an integral part thereof - in order to enable Parliament to assess more effectively and with greater transparency whether or not the various objectives stated in the Agreement have been achieved, whether or not the Agreement is fully operational, whether or not it acts in the interests of the parties involved and whether or not it is cost-effective for the Community and its fisheries sector. This will afford the sector greater legal security, including monitoring of the application of the exclusivity clause laid down in the Agreement (Article 6) in order to ensure that other parties are not offered (by means of private agreements) opportunities to fish for high-commercial-value species which are withheld from the Community under the public Agreement on the pretext that resources have to be conserved.

(5 bis) L'Union européenne reconnaît le rôle de l'Accord sur un programme international de conservation des dauphins (APICD) dans la défense d'une pêche durable, ainsi que du processus de certification visé par cet accord pour garantir la préservation écologique d'autres espèces, et notamment des dauphins.
(5a) The European Union recognises the importance of the Agreement on the International Dolphin Conservation Programme (AIDCP) in protecting sustainable fishing, and its certification scheme as a means of guaranteeing the ecological conservation of other species, particularly dolphins.

En conclusion je voudrais, Monsieur le Président, faire une très brève observation sur un point qui a été abordé par Mme Meij-Weggen dans son rapport, qui concerne l'accord-cadre entre nos deux institutions et rappelait au préalable la nature différente des deux actes que sont, d'une part, le règlement du 30 mai 2001 et, d'autre part, l'accord-cadre que je viens d'évoquer.
In conclusion, Mr President, I would like to make a very brief comment about a point that Mrs Maij-Weggen raised in her report, which concerns the framework agreement between our two institutions, and reiterated the different nature of the two acts – firstly, the regulation of 30 May 2001 and secondly, the framework agreement that I have just mentioned.

Le Conseil souligne l'importance de certaines conventions internationales qui appliquent les principes de la conservation et de l'utilisation durable de la diversité biologique et il estime que les moyens ci-après devraient être mis en oeuvre pour assurer la coopération avec d'autres conventions internationales : i) le secrétariat de la convention devrait élaborer et tenir un catalogue des sujets complémentaires, tant juridiques qu'administratifs, qui sont traités dans d'autres conventions, particulièrement ceux qui sont liés au programme de travail, et diffuser ce catalogue parmi les parties contractantes en vue d'assurer un maximum d'efficacité et d'éviter les doubles emplois ; ii) le secrétariat de la convention devrait suggérer et accepter de participer à des initiatives émanant des secrétariats d'autres conventions afin d'assurer l'échange des expériences et d'encourager des accords d'intérêt mutuel concernant la conservation de la diversité biologique, son utilisation durable et le partage des avantages découlant de son exploitation.
The Council emphasizes the importance of certain international Conventions which apply the principles of biodiversity conservation and sustainable use, and finds that, as regards the means of cooperation with other International Conventions, the following relationships should be established: (i) the Secretariat of the Convention should draw up and keep a Catalogue of complementary subjects, both legal and administrative, dealt with by other Conventions, specially those related to the programme of work, and distribute it among the contracting parties, with the aim of achieving maximum efficiency and avoiding duplication in efforts; (ii) the Secretariat of the Convention should invite and agree to participate in initiatives from Secretariats of other Conventions in order to exchange experiences and encourage agreements of mutual interest concerning the conservation of biological diversity, its sustainable use and the sharing of benefits deriving from its use.
