The European Commission has decided to refer Austria to the Court of Justice of the EU for incorrectly applying Value Added Tax (VAT) to royalty payments paid to artists for the resale of works of art. The Resale Right Directive was designed to achieve two objectives: on the one hand, to ensure that authors of graphic and plastic works of art share in the economic success of their creations, and, on the other hand, to harmonise the application of the resale right in the EU.

For the purposes of this Directive, "original work of art" means works of graphic or plastic art such as pictures, collages, paintings, drawings, engravings, prints, lithographs, sculptures, tapestries, ceramics, glassware and photographs, provided they are made by the artist himself or are copies considered to be original works of art.
