In so far as confidentiality is concerned, the relevant provisions of the Staff Regulations of Officials of the European Communities and the conditions of employment of other servants of the European Communities should apply to officials or other servants employed and working in connection with SIS II.

By way of derogation from paragraph 1(a)(i) the Appointing Authority shall, and by way of derogation from paragraph 1(b) the Appointing Authority may, consider the possibility of filling a vacant post by appointing as officials temporary servants engaged in accordance with Article 2(c) of the Conditions of Employment of other servants of the European Communities to assist a political group in the European Parliament, the European Economic and Social Committee or the Committee of the Regions, provided that they have passed a selection procedure in accordance with Article 1b(2b), of the Staff Regulations of officials of the European Communities and have been in service as such temporary servants for more than seven years".

Any failure to comply with the obligations pursuant to this Regulation, whether intentionally or through negligence on his or her part, shall make an official or other servant of the European Communities liable to disciplinary action, in accordance with the rules and procedures laid down in the Staff Regulations of Officials of the European Communities or in the conditions of employment applicable to other servants.

Without prejudice to paragraph (2), the staff assigned to the Data Protection Secretariat shall be subject to the Regulations and rules applicable to officials and other servants of the European Communities. As regards the exercise of the powers conferred by the Staff Regulations on the appointing authority and the powers under the Conditions of employment of other servants of the European Communities, the staff shall be subject to the same rules as the officials and other agents of the General Secretariat of the Council .
Onverminderd het bepaalde in het voorgaande lid, is het personeel van het secretariaat onderworpen aan het Statuut.
