The scope of this Regulation should therefore be aligned with that of Regulation (EU) No 1305/2013, in particular as regards aid in favour of the forestry sector and aid in favour of micro and small and medium-sized enterprises (SMEs) active in rural areas.
Het toepassingsgebied van deze verordening moet dan ook worden afgestemd op dat van Verordening (EU) nr. 1305/2013, met name wat betreft steun voor de bosbouwsector en steun voor kleine, middelgrote en micro-ondernemingen (kmo's) die in plattelandsgebieden actief zijn.

This Regulation should apply to aid measures in favour of forestry and in favour of SMEs active in the rural areas which fall outside the scope of Article 42 of the Treaty which are covered by Regulation (EU) No 1305/2013 only and insofar as those measures are included in the rural development programmes and are co-financed by the EAFRD.
Deze verordening moet van toepassing zijn op buiten het toepassingsgebied van artikel 42 van het Verdrag en binnen het toepassingsgebied van Verordening (EU) nr. 1305/2013 vallende steunmaatregelen voor de bosbouw en voor kmo's die in plattelandsgebieden actief zijn, maar slechts in zoverre deze maatregelen in de plattelandsontwikkelingsprogramma's zijn opgenomen en uit het Elfpo worden gecofinancierd.

Taking into account that the processing of agricultural products and the marketing of agricultural products is similar to that of industrial products, it is appropriate to align the threshold for the publication of information on individual aid awards to beneficiaries in those sub-sectors, as well as in the forestry sector and for activities falling outside the scope of Article 42 of the Treaty, to that set in Commission Regulation (EU) No 651/2014 (14).
Rekening houdend met het feit dat de verwerking en de afzet van landbouwproducten vergelijkbaar zijn met die van industriële producten, moet de drempel voor de bekendmaking van informatie over de toekenning van individuele steun aan begunstigden in deze subsectoren en in de bosbouwsector, en voor activiteiten die buiten de werkingssfeer van artikel 42 van het Verdrag vallen, worden gelijkgetrokken met die van Verordening (EU) nr. 651/2014 van de Commissie (14).

On the other hand, this Regulation should not apply to aid to undertakings in rural areas for activities falling outside the scope of Article 42 of the Treaty or to the forestry sector where there is no direct link to the rural development programmes and no co-financing from the EAFRD.
Deze verordening mag daarentegen niet van toepassing zijn op steun aan ondernemingen in plattelandsgebieden voor activiteiten die buiten het toepassingsgebied van artikel 42 van het Verdrag vallen, of op steun voor de bosbouwsector wanneer er geen rechtstreekse link naar de plattelandsontwikkelingsprogramma's en geen cofinanciering uit het Elfpo is.

For forestry measures forming part of a rural development programme, benefiting from EAFRD support, the restrictions as to the scope of aid beneficiaries laid down in Regulation (EU) No 1305/2013 apply, except for the tropical or subtropical forests and to the woodland of the territories of the Azores, Madeira, the Canary Islands, the smaller Aegean islands within the meaning of Regulation (EU) No 229/2013 and of the French overseas departments, in Sections 2.1.1 to 2.1.5 of Part II of these Guidelines.
Voor bosbouwmaatregelen die deel uitmaken van een plattelandsontwikkelingsprogramma en waarvoor steun uit het ELFPO wordt verleend, zijn de in Verordening (EU) nr. 1305/2013 vastgestelde beperkingen inzake de aard van de begunstigden van de steun van toepassing op de afdelingen 2.1.1 tot en met 2.1.5 van deel II van deze richtsnoeren, behalve wat betreft de tropische of subtropische bossen en de beboste gronden van de Azoren, Madeira, de Canarische Eilanden, de kleinere eilanden in de Egeïsche Zee in de zin van Verordening (EU) nr. 229/2013 en de Franse overzeese departementen.

Your Rapporteur is aware that ATVs have proven their value in agricultural and forestry applications, and that part of the industry producing such vehicles has requested their inclusion in the scope of this Regulation.
Het is de rapporteur bekend dat ATV's hun waarde in de landbouw en bosbouw hebben bewezen, en dat fabrikanten van dergelijke voertuigen hebben verzocht deze in het toepassingsgebied van deze verordening op te nemen.

Your Rapporteur wishes to highlight that agricultural and forestry tractors could be excluded from the scope of the Machinery Directive provided that the new Regulation and its delegated acts fully carry over the existing requirements laid down in the Machinery Directive that are currently applicable to tractors so as to avoid any legal gaps and to ensure that the current level of safety is maintained.
De rapporteur wenst te onderstrepen dat landbouw- en bosbouwtrekkers alleen van het toepassingsgebied van de machinerichtlijn kunnen worden uitgesloten indien de bestaande voorschriften van de machinerichtlijn die momenteel voor trekkers gelden volledig in de nieuwe verordening en de bijbehorende gedelegeerde handelingen worden overgenomen, teneinde juridische leemten te vermijden en ervoor te zorgen dat het huidige veiligheidsniveau wordt gehandhaafd.

The Commission proposes to exclude agricultural and forestry tractors from the scope of the Machinery Directive with the view to reducing the number of legal acts applicable to tractors in the interest of better regulation and simplification.
