The decision of the European Commission of 19 December 2012 reassigning Mr Pipiliagkas to the Shared Resources Directorate of the Directorate-General Mobility and Transport in Brussels (Belgium) with effect from 1 January 2013 is annulled.

Believes that the Parliament's places of work should be limited to a single seat for Members and officials; calls on the Council to take into account the demands expressed already on several occasions by the Parliament and EU citizens concerning the need to fix a single seat for the Members and officials, further reiterated in paragraph 7 of the resolution of the European Parliament of 16 February 2012 on the guidelines for the 2013 budget procedure, sections other than the Commission;

Therefore, as to the actual details regarding the responsibilities, staff, funding and the actual seat, the Commission cannot yet comment on them, as they will be subject of a feasibility study carried out in the course of 2011. A wide consultation with the Member States, relevant agencies and institutions, the private sector and civil society is expected to be conducted for the purpose of the feasibility study.
De Commissie kan daarom nu nog niets concreets zeggen over de bevoegdheden, het personeel, de financiering en de zetel, aangezien deze aspecten meegenomen zullen worden in een haalbaarheidsstudie die in de loop van 2011 zal worden verricht. However, the Council cannot commit to reassigning funds without respecting the Commission’s right of initiative and the powers shared by Parliament in this area.

3. Whenever it appears to the Commission, either on the basis of the reports referred to in paragraph 2 or on the basis of other information, that a third country does not grant undertakings having their seat or their principal fields of activity in the Community, treatment comparable to that granted by the Community to undertakings from that country, the Commission may submit proposals to the Council for an appropriate mandate for negotiation with a view to obtaining comparable treatment for undertakings having their seat or their principal fields of activity in the Community.

Indien de Commissie op grond van de in lid 2 bedoelde verslagen of op basis van andere informatie vaststelt dat een derde land de ondernemingen die hun zetel of hun belangrijkste werkterreinen in de Gemeenschap hebben, geen behandeling geeft die vergelijkbaar is met die welke de Gemeenschap toekent aan ondernemingen van dat derde land, kan zij aan de Raad voorstellen doen om een passend onderhandelingsmandaat te verkrijgen, teneinde voor ondernemingen die hun zetel of hun belangrijkste werkterreinen in de Gemeenschap hebben, een vergelijkbare behandeling te verkrijgen.
