IN-CONTEXT TRANSLATIONS

In particular, this Regulation lays down provisions related to the shared management with Member States based on the principles of sound financial management, transparency and non-discrimination, as well as provisions on the function of accredited bodies, the budgetary principles, provisions which should be respected in the framework of this Regulation.

4. In accordance with Article 16 of Regulation (EU) No 1095/2010 , ESMA shall issue guidelines addressed to competent authorities which comply with Article 14b. Those guidelines shall take into account the principles on sound remuneration policies set out in Recommendation 2009/384/EC, the size of the management company and the size of UCITS they manage, their internal organisation and the nature, the scope and the complexity of their activities.
4. ESMA geeft in overeenstemming met artikel 16 van Verordening (EU) nr. 1095/2010 voor de bevoegde autoriteiten richtsnoeren die voldoen aan artikel 14 ter. In deze richtsnoeren wordt ook rekening gehouden met de beginselen voor een gezond beloningsbeleid die zijn vastgelegd in Aanbeveling 2009/384/EG , alsmede met de omvang van de beheermaatschappijen en de door hen beheerde icbe’s, hun interne organisatie en de aard, reikwijdte en complexiteit van hun werkzaamheden.

In order to address the potentially detrimental effect of poorly designed corporate governance arrangements on the sound management of risk, Member States should introduce principles and standards to ensure effective oversight by the management body, promote a sound risk culture at all levels of credit institutions and investment firms and enable competent authorities to monitor the adequacy of internal governance arrangements.

As part of the monitoring procedures of the World Bank on adjustment loans, and following the principles of sound financial management, I prepared the relevant part of Implementation Completion Reports (ICR) on behalf of MAF which evaluated the effectiveness of the projects, their sustainability and the compliance with the legal and regulatory frameworks, as well as the policies of the World Bank. This procedure for which I was primary responsible at MAF was considered as an internal compliance and performance audit for the project.

2. ESMA shall ensure the existence of guidelines on sound remuneration policies which comply with Annex II. The guidelines shall take into account the principles on sound remuneration policies set out in Recommendation 2009/384/EC, the size of the AIFMs and the size of AIFs they manage, their internal organisation and the nature, the scope and the complexity of their activities.
