Although the initiative focuses on oil, gas, and mining and does not include timber, it nevertheless establishes interesting principles for co-operation between the private sector and producer and consumer countries which could be applicable in the context of the FLEGT programme.

Since the objective of this Directive, namely establishing minimum requirements for preventing major accidents in offshore oil and gas operations and limiting the consequences of such accidents, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale and effects of the proposed action, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

It is nonetheless desirable that those Member States promote the principles and high standards existing in Union law for the safety of offshore oil and gas operations in their bilateral contacts with third countries and with relevant international organisations.
Niettemin is het wenselijk dat deze lidstaten de beginselen en hoge normen op het gebied van de veiligheid van offshore olie- en gasactiviteiten van het recht van de Unie propageren in hun bilaterale contacten met derde landen en met de betrokken internationale organisaties.

6. Licensees, operators and major contractors based in the Union shall endeavour to conduct their offshore oil and gas operations when outside the Union in accordance with the principles set out in this Regulation.

Recalls that the ‘polluter pays’ principle must be consistently applied to shale gas and shale oil operations, particularly regarding waste water treatment, and that companies must be fully liable for any direct or indirect damage they might cause; urges the Commission to assess the need to put forward proposals for specifically including hydraulic fracturing and other activities related to shale gas extraction in the Environmental Liability Directive and to oblige shale gas operators to provide compulsory financial security or insurance requirements in case of any environmental damage linked to their activities, in order to provide legal certainty for the populations concerned;
