Member States shall take the measures necessary to ensure that non-payment of compulsory contributions due from the employer, before the onset of his insolvency, to their insurance institutions under national statutory social security schemes does not adversely affect employees’ benefit entitlement in respect of these insurance institutions in so far as the employees’ contributions have been deducted at source from the remuneration paid.
De lidstaten treffen de nodige maatregelen om ervoor te zorgen dat het niet-betalen aan hun verzekeringsinstellingen van door de werkgever vóór het intreden van diens insolventie verschuldigde premiebedragen uit hoofde van de nationale wettelijke stelsels van sociale zekerheid, het recht van de werknemer op prestaties ten aanzien van deze verzekeringsinstellingen niet nadelig beïnvloedt, voor zover de loonpremies op het uitgekeerde loon zijn ingehouden.

Member States may stipulate that Articles 3, 4 and 5 shall not apply to contributions due under national statutory social security schemes or under supplementary occupational or inter-occupational pension schemes outside the national statutory social security schemes.
De lidstaten kunnen voorschrijven dat de artikelen 3, 4 en 5 niet gelden voor de premiebedragen uit hoofde van nationale wettelijke stelsels van sociale zekerheid of uit hoofde van voor een of meer bedrijfstakken geldende aanvullende stelsels van sociale voorzieningen welke bestaan naast de nationale wettelijke stelsels van sociale zekerheid.

Member States shall ensure that the necessary measures are taken to protect the interests of employees and of persons having already left the employer’s undertaking or business at the date of the onset of the employer’s insolvency in respect of rights conferring on them immediate or prospective entitlement to old-age benefits, including survivors’ benefits, under supplementary occupational or inter-occupational pension schemes outside the national statutory social security schemes.
De lidstaten vergewissen zich ervan dat de nodige maatregelen worden getroffen om de belangen van de werknemers en die van de personen die de onderneming of vestiging van de werkgever op de datum van het intreden van de insolventie van de werkgever reeds hebben verlaten, te beschermen met betrekking tot hun verkregen rechten of hun rechten in wording op ouderdomsuitkeringen, met inbegrip van uitkeringen aan nagelaten betrekkingen, uit hoofde van voor een of meer bedrijfstakken geldende aanvullende stelsels van sociale voorzieningen welke bestaan naast de nationale wettelijke stelsels van sociale zekerheid.

However, managers of private equity funds or AIFMs managing AIFs whose shares are admitted to trading on a regulated market should not be excluded from its scope. Further, this Directive should not apply to the management of pension funds; employee participation or savings schemes; supranational institutions; national central banks; national, regional and local governments and bodies or institutions which manage funds supporting social security and pension systems; securitisation special purpose entities; or insurance contracts and joint ventures.
Verder is deze richtlijn niet van toepassing op het beheer van pensioenfondsen; werknemerswinstdelings- of werknemersspaarplannen; supranationale instellingen; nationale centrale banken; nationale, regionale en lokale overheden en organen of instellingen die fondsen ter ondersteuning van socialezekerheids- en pensioenstelsels beheren; voor een bijzonder doel opgerichte securitiseringsvehikels of verzekeringscontracten en joint ventures.

However, this regulation lays down the general principle that all national governments, social security institutions and even courts have to comply when applying national legislation.
In deze verordening is echter het algemene beginsel verankerd dat alle nationale regeringen, socialezekerheidsinstellingen en zelfs rechtbanken aan de communautaire bepalingen moeten voldoen wanneer zij nationale wetten toepassen.

5. Stresses the need to improve the situation of ethnic minorities in Bulgaria, such as Roma and Turks, and calls on the Bulgarian Government to ensure that these groups are not discriminated against with regard to access to national education, social security, health care and employment systems and to counter vigorously any discriminating pronouncements or actions against them;
