Regrets the fact that the Doha WTO Conference did not address the issue of patenting living things when the TRIPS agreement was being negotiated, since it considers that that agreement, which enables life forms and natural processes to be protected by means of a patent (Article 27(3b)), constitutes a threat not only to biological diversity but also to the rights and the survival of local populations; calls, therefore, for the TRIPS agreement to be thoroughly revised so as to ensure that all living organisms and their constituent elements are excluded from its scope and for the provisions of the Convention on Biological Diversity which relate to national sovereignty, fully informed prior consent and profit-sharing to be observed;
7. betreurt dat de WTO-conferentie van Doha zich niet in het kader van de onderhandelingen over het TRIP's-akkoord heeft beziggehouden met de kwestie van het octrooieren van leven; is namelijk van mening dat dit akkoord, dat de octrooiering van levensvormen en natuurlijke processen mogelijk maakt (art. 27, 3b), niet alleen gevaar oplevert voor de biologische diversiteit, maar ook voor de rechten en de overlevenskansen van de plaatselijke bevolkingen; wenst derhalve dat het TRIP's-akkoord grondig wordt herzien, in dier voege dat alle levende organismen, alsmede de elementen waaruit deze zijn opgebouwd, uit het toepassingsgebied worden geschrapt en dat de bepalingen van het Verdrag inzake biologische diversiteit die de nationale soevereiniteit, voorafgaande volledig geïnformeerde toestemming en de verdeling van de opbrengsten betreffen, worden geëerbiedigd;
