IN-CONTEXT TRANSLATIONS

Regulation (EU) No 1011/2012 (ECB/2012/24) has been amended to: (i) clarify the scope of the group data reporting agents which can be identified as part of the actual reporting population by the Governing Council for the purpose of that Regulation, and (ii) to incorporate the possibility that group data pursuant to Article 3a of Regulation (EU) No 1011/2012 (ECB/2012/24) can be directly reported to the European Central Bank (ECB).
Verordening (EU) nr. 1011/2012 (ECB/2012/24) werd gewijzigd om: i) het toepassingsgebied van de groepsgegevens rapporterende informatieplichtigen te verduidelijken die door de Raad van bestuur binnen het kader van die verordening kunnen worden geïdentificeerd als onderdeel van de werkelijke populatie van informatieplichtigen, en ii) om het mogelijk te maken dat groepsgegevens krachtens artikel 3 bis van Verordening (EU) nr. 1011/2012 (ECB/2012/24) direct kunnen worden gerapporteerd aan de Europese Centrale Bank (ECB).

We hereby notify you, on behalf of the European Central Bank (ECB), that [legal name of group data reporting agent] has been classified by the ECB's Governing Council as a group data reporting agent for statistical purposes, in accordance with Article 2(1)(b) and Article 2(4) of Regulation (EU) No 1011/2012 (ECB/2012/24).

2. Unless otherwise decided by the Governing Council, the ECB shall distribute to the NCBs its income on euro banknotes in circulation accrued and its income arising from securities earned in each financial year on the last working day in January of the following year.
2. Tenzij de Raad van bestuur anderszins besluit, verdeelt de ECB haar in de loop van elk boekjaar verkregen inkomsten uit eurobankbiljetten in omloop en haar inkomsten uit effecten in elk boekjaar op de laatste werkdag van januari van het volgende jaar.

Article 24 of Decision ECB/2010/21 stipulates that if a specific accounting treatment is not laid down in Decision ECB/2010/21 and in the absence of a decision to the contrary of the Governing Council, the ECB shall follow valuation principles in accordance with the International Accounting Standards (IAS) as adopted by the European Union, which are relevant to the ECB’s activities and accounts.

Taking account of the principle of separation and the establishment of the Supervisory Board and the Administrative Board of Review, two distinct procedures should apply: (a) where the ECB contemplates the imposition of administrative penalties in the exercise of its supervisory tasks, decisions to this effect are taken by the Governing Council of the ECB based on a complete draft decision from the Supervisory Board and subject to review by the Administrative Board of Review; and (b) where the ECB contemplates the imposition of sanctions in the exercise of its non-supervisory tasks, decisions to this effect are taken by the Executive Board of the ECB and subject to review by the Governing Council of the ECB.

However, in exceptional circumstances and unless not less than three Governors state their wish to retain the competence of the Governing Council for the adoption of specific opinions, ECB Opinions may be adopted by the Executive Board, in line with comments provided by the Governing Council and taking into account the contribution of the General Council.
In uitzonderlijke omstandigheden en tenzij ten minste drie presidenten van een centrale bank de wens te kennen geven dat de Raad van bestuur de bevoegdheid behoudt om bepaalde adviezen goed te keuren, kunnen ECB-adviezen evenwel door de directie worden goedgekeurd, in overeenstemming met door de Raad van bestuur geplaatste opmerkingen en met inachtneming van de inbreng van de Algemene Raad.

8. Without prejudice to Article 6, the Supervisory Board shall carry out preparatory works regarding the supervisory tasks conferred on the ECB and propose to the Governing Council of the ECB complete draft decisions to be adopted by the latter, pursuant to a procedure to be established by the ECB.
8. Onverminderd artikel 6, verricht de raad van toezicht de voorbereiding met betrekking tot de aan de ECB opgedragen toezichttaken en legt hij de raad van bestuur van de ECB volledige ontwerpbesluiten voor ter aanneming door laatstgenoemde, volgens een in door de ECB vast te stellen procedure.

The introduction by any and all NACs into the CMS of data relating to counterfeit euro banknotes which are discovered and the sending of every new type of suspected counterfeit euro banknotes to the CAC of the ECB takes place in accordance with Regulation (EC) No 1338/2001 and with the relevant manual of procedures approved by the Governing Council of the ECB with the contribution of the General Council of the ECB.
