Directive 2010/24 was preceded by Council Directive 2008/55/EC of 26 May 2008 on mutual assistance for the recovery of claims relating to certain levies, duties, taxes, and other measures (OJ 2008 L 150, p. 28) and Council Directive 76/308/EEC of 15 March 1976 on mutual assistance for the recovery of claims resulting from operations forming part of the system of financing the European Agricultural Guidance and Guarantee Fund, and of the agricultural levies and customs duties (OJ 1976 L 73, p. 18).

In order to ensure uniform conditions for the implementation of this Regulation as regards imports, implementing powers should be conferred on the Commission in respect of measures determining the processed agricultural products to which additional import duties should apply in order to prevent or counteract adverse effects on the Union market, measures for the application of those additional import duties as regards time limits for proving the import price, for the submission of documentary evidence, and for determining the level of the additional import duties, measures fixing the representative prices and trigger volumes for the purposes of applying additional import duties, measures on the format and the content of the import licence for ovalbumin and lactalbumin, on the submission of applications and the issuing and use of those import licences, on their period of validity, on the procedure for lodging a security in respect of those licences and its amount, on the evidence needed to prove that the requirements for the use of those licences have been fulfilled, on the level of tolerance as regards compliance with the obligation to import the quantity mentioned in the import licence, and on the issuing of replacement and duplicate import licences, measures on the treatment of import licences by the Member States, as well as on the exchange of information needed for the management of the system of import licences for ovalbumin and lactalbumin, including the procedures relating to specific administrative assistance between Member States, to the calculation of import duties and to the fixing of the level of import duties for processed agricultural products in the implementation of international arrangements.

Council Regulation (EC) No 2073/2004 of 16 November 2004 on administrative cooperation in the field of excise duties provides for a common system whereby, in order to ensure the correct application of legislation on excise duties and to combat the evasion of excise duties and the ensuing distortions in the internal market, Member States assist each other and cooperate with the Commission.
Verordening (EG) nr. 2073/2004 van de Raad van 16 november 2004 betreffende de administratieve samenwerking op het gebied van de accijnzen voorziet in een gemeenschappelijke regeling in het kader waarvan de lidstaten elkaar bijstand verlenen en samenwerken met de Commissie met het oog op de juiste toepassing van de accijnswetgeving en de bestrijding van de ontduiking van accijnsrechten en de daaruit voortvloeiende verstoringen van de interne markt.

2. Where the third country concerned has given a legal undertaking to provide the assistance required to gather evidence of the irregular nature of transactions which appear to contravene legislation on excise duties, information obtained under this Regulation may be communicated by the competent authority of a Member State to that third country, in accordance with that Member State’s national law regarding transfers of personal data to third countries, for the purposes of the correct application of excise duties or similar taxes, duties and charges applicable in the third country with the consent of the competent authorities which supplied the information, in accordance with their national law.
2. Wanneer een derde land er zich juridisch toe verbonden heeft de bijstand te verlenen die nodig is om bewijsmateriaal bijeen te brengen omtrent het onregelmatige karakter van verrichtingen die strijdig lijken met de accijnswetgeving, kunnen krachtens deze verordening verkregen inlichtingen door de bevoegde autoriteit van een lidstaat aan dat derde land worden meegedeeld, overeenkomstig de nationale wetgeving van die lidstaat ten aanzien van de doorgifte van persoonlijke gegevens aan derde landen, met het oog op de correcte toepassing van in het derde land bestaande accijnzen of soortgelijke belastingen, rechten en heffingen, met de toestemming van de bevoegde autoriteiten die deze hebben verstrekt, in overeenstemming met hun nationale wetgeving.

Regulation (EC) No 2073/2004 of the European Parliament and of the Council of 16 November 2004 on administrative cooperation in the field of excise duties (3) incorporates all the provisions designed to facilitate administrative cooperation in the field of excise duties contained in Directives 77/799/EEC (4) and 92/12/EEC (5) with the exception of mutual assistance provided for by Council Directive 76/308/EEC of 15 March 1976 on mutual assistance for the recovery of claims relating to certain levies, duties, taxes and other measures (6).
Te dien einde werden alle bepalingen ter vergemakkelijking van de administratieve samenwerking inzake accijnzen die zijn opgenomen in Richtlijn 77/799/EEG (3) alsmede in Richtlijn 92/12/EEG (4), samengebracht in Verordening (EG) nr. 2073/2004 van het Europees Parlement en de Raad van 16 november 2004 betreffende de administratieve samenwerking op het gebied van de accijnzen (5), met uitzondering van de wederzijdse bijstand als bepaald in Richtlijn 76/308/EEG van de Raad van 15 maart 1976 betreffende de wederzijdse bijstand inzake de invordering van schuldvorderingen die voortvloeien uit bepaalde bijdragen, rechten en belastingen, alsmede uit andere maatregelen (6).

Mutual assistance and administrative cooperation in the field of excise duties are governed by Council Directive 77/799/EEC of 19 December 1977 concerning mutual assistance by the competent authorities of the Member States in the field of direct taxation, certain excise duties and taxation of insurance premiums (3).
De wederzijdse bijstand en de administratieve samenwerking op het gebied van accijnzen is geregeld bij Richtlijn 77/799/EEG van de Raad van 19 december 1977 betreffende de wederzijdse bijstand van de bevoegde autoriteiten van de lidstaten op het gebied van de directe belastingen, bepaalde accijnzen en heffingen op verzekeringspremies (3).

At the request of the requesting authority, the requested authority shall, in accordance with the rules governing similar notifications in force in its own Member State, notify the addressee of all administrative decisions and measures taken by the administrative authorities of the requesting Member State concerning the application of legislation on excise duties, except those referred to in Article 5 of Council Directive 76/308/EEC of 15 March 1976 on mutual assistance for the recovery of claims relating to certain levies, duties, taxes and other measures (12).
Op verzoek van de verzoekende autoriteit gaat de aangezochte autoriteit, overeenkomstig de geldende voorschriften betreffende soortgelijke kennisgevingen, over tot kennisgeving aan de geadresseerde van alle door de administratieve autoriteiten van de verzoekende lidstaat genomen beslissingen en maatregelen die betrekking hebben op de toepassing van de accijnswetgeving, met uitzondering van die welke in artikel 5 van Richtlijn 76/308/EEG van de Raad van 15 maart 1976 betreffende wederzijdse bijstand inzake de invordering van schuldvorderingen die voortvloeien uit bepaalde bijdragen rechten en belastingen, alsmede uit andere maatregelen (12) worden bedoeld.
