In view of its responsibilities for the environment and trade, the Community, pursuant to Council Decision 88/540/EEC , has become a Party to the Vienna Convention for the Protection of the Ozone Layer and the Montreal Protocol on Substances that Deplete the Ozone Layer (hereinafter ‘the Protocol’).

This Regulation lays down rules on the production, import, export, placing on the market, use, recovery, recycling, reclamation and destruction of substances that deplete the ozone layer, on the reporting of information related to those substances and on the import, export, placing on the market and use of products and equipment containing or relying on those substances.
Bij deze verordening worden regels vastgesteld voor de productie, de invoer, de uitvoer, het op de markt brengen, het gebruik, de terugwinning, de recycling, de regeneratie en de vernietiging van stoffen die de ozonlaag afbreken, voor de rapportage van gegevens in samenhang met die stoffen en voor de invoer, de uitvoer, het op de markt brengen en het gebruik van producten en apparaten die dergelijke stoffen bevatten of nodig hebben.

The regulation on substances that deplete the ozone layer is primarily aimed at protecting the stratospheric ozone layer, but also at preventing climate change.
De verordening ozonlaagafbrekende stoffen is in de eerste plaats gericht op het beschermen van de stratosferische ozonlaag, maar ook op het voorkomen van klimaatsverandering.

As early as 1987, governments agreed on the Montreal Protocol on Substances that Deplete the Ozone Layer, thereby starting the phase-out of ozone-depleting substances (ODS) in all signatories following a set timetable.
Al in 1987 hebben de regeringen overeenstemming bereikt over het Protocol van Montreal betreffende stoffen die de ozonlaag afbreken, waarmee een begin werd gemaakt met de geleidelijke eliminatie van stoffen die de ozonlaag afbreken (ozone-depleting substances – ODS) in alle ondertekenende landen, aan de hand van een vast tijdschema.

At those meetings, an examination of the proposal for a regulation of the European Parliament and of the Council recasting Regulation (EC) No 2037/2000 of the European Parliament and of the Council of 29 June 2000 on substances that deplete the ozone layer resulted in the Consultative Working Party’s establishing, by common accord, as follows.
Tijdens deze bijeenkomst werd het voorstel voor een verordening van het Europees Parlement en de Raad voor een herschikking van Verordening (EG) nr. 2037/2000 van het Europees Parlement en de Raad van 29 juni 2000 betreffende de ozonlaag afbrekende stoffen behandeld, waarbij de Adviesgroep in onderlinge overeenstemming tot de hierna uiteengezette conclusies is gekomen.

Decision IX/24 states: “That any Party may bring to the attention of the Secretariat the existence of new substances which it believes have the potential to deplete the ozone layer and have the likelihood of substantial production, but which are not listed as controlled substances under Article 2 of the Protocol..”.
In Besluit IX/24 staat dat elke partij het secretariaat in kennis kan stellen van het bestaan van nieuwe stoffen die naar zijn mening de ozonlaag kunnen afbreken en waarschijnlijk in substantiële hoeveelheden zullen worden geproduceerd, maar niet zijn geregistreerd als gereguleerde stoffen uit hoofde van artikel 2 van het Protocol.
