(7) This Regulation replaces Council Decision 2010/252/EU which was annulled by the Court of Justice of the European Union ('the Court') by its judgment of 5 September 2012 in Case C-355/10. In that judgment, the Court maintained the effects of Decision 2010/252/EU until the entry into force of new rules.

33. stelt vast dat procedures krachtens artikel 228 van het EG-Verdrag sinds de inwerkingtreding daarvan slechts in drie gevallen hebben geleid tot een arrest van het Hof van Justitie; is verheugd over de mededeling van de Commissie over de toepassing van artikel 228 van het EG-Verdrag (SEC(2005)1658) die het beleid van de Commissie verduidelijkt en verder ontwikkelt door het Hof van Justitie te verzoeken een periodieke betaling en de betaling van een forfaitaire som op te leggen aan lidstaten die het arrest van het Hof niet naleven;

1. If the Court of Justice finds that a Member State has failed to fulfil an obligation under this Treaty, the State shall be required to take the necessary measures to comply with the judgment of the Court of Justice.
1. Indien het Hof van Justitie vaststelt dat een lidstaat een der krachtens dit Verdrag op hem rustende verplichtingen niet is nagekomen, is deze staat gehouden die maatregelen te nemen welke nodig zijn ter uitvoering van het arrest van het Hof van Justitie.

If the Court of Justice finds that a national central bank has failed to fulfil an obligation under this Treaty, that bank shall be required to take the necessary measures to comply with the judgment of the Court of Justice.
Indien het Hof van Justitie vaststelt dat een nationale centrale bank een der krachtens dit Verdrag op haar rustende verplichtingen niet is nagekomen, is deze bank gehouden die maatregelen te nemen welke nodig zijn ter uitvoering van het arrest van het Hof van Justitie.

106. Urges Member States to act to eliminate discriminatory rules and practices, in relation in particular to the recognition of diplomas and the situation of border workers; urges the Netherlands to stop violating Regulation 1408/71, as determined by the Court of Justice judgment in Case C-311/01; notes, despite the decree law of 14 January 2004, the Italian Government’s continuing failure to comply fully with the Court of Justice’s judgment in Case C-212/99 concerning foreign lecturers and that the Commission is now seeking financial penalties;
106. dringt er bij de lidstaten op aan werk te maken van de eliminatie van discriminerende regelgeving en praktijken, met name met betrekking tot de erkenning van diploma's en de positie van grensarbeiders; spoort Nederland aan tot stopzetting van de schending van Verordening 1408/71, zoals vastgesteld in het arrest van het Hof van Justitie in de zaak C-311/01; constateert dat de Italiaanse regering, ondanks de vaststelling van het decreet van 14 januari 2004, nog steeds niet volledig voldoet aan het arrest van het Hof van Justitie in zaak C-212/99 betreffende lectoren vreemde talen en dat de Commissie thans financiële sancties wil opleggen;
