In October 2011, the Commission will report on the implementation and effects of the Resale Right Directive.[30] It is currently conducting a public consultation to address a wide range of questions relating to the implementation of this Directive, including: the impact of the Directive on the internal market, on the competitiveness of the EU market in modern and contemporary art, on the effect of the introduction of the resale right in those Member States that did not apply the resale right in national law prior to the entry into force of the Directive,[31] and on the fostering of artistic creativity.

This law constitutes a comprehensive legal text covering the scope of protection, including rights and exceptions, provisions on the protection of technological measures, copyright contract law, collecting societies as well as enforcement of rights and the artist's resale right.

2. By way of derogation from paragraph 1, those Member States which do not apply the resale right on (the entry into force date referred to in Article 13), shall not be required, for a period expiring not later than 1 January 2010, to apply the resale right for the benefit of those entitled under the artist after his/her death.

In afwijking van lid 1 behoeven de lidstaten die op [de in artikel 13 bedoelde datum van inwerkingtreding] het volgrecht niet toepassen, gedurende een termijn die uiterlijk verstrijkt op 1 januari 2010, het volgrecht niet toe te passen ten behoeve van rechtsopvolgers van een kunstenaar na diens overlijden.

3. A Member State to which paragraph 2 applies may have up to two more years, if necessary to enable the economic operators in that Member State to adapt gradually to the resale right system while maintaining their economic viability, before it is required to apply the resale right for the benefit of those entitled under the artist after his/her death.

Een lidstaat als bedoeld in lid 2 beschikt over een extra termijn van ten hoogste twee jaar alvorens hij het volgrecht ten behoeve van rechtsopvolgers van een kunstenaar na diens overlijden moet toepassen indien zulks nodig is om de economische actoren in die lidstaat in staat te stellen zich geleidelijk aan het volgrechtstelsel aan te passen en hun economische levensvatbaarheid toch in stand te houden.
