For the purposes of this Agreement, ‘the Parties’ shall mean the Community, its Member States or the Community and its Member States, within their respective areas of competence, as derived from the Treaty establishing the European Community, on the one hand, and the Republics of Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua and Panama, on the other, in accordance with their respective spheres of competence.

We all know that the framework agreement concerning relations between the Commission and the European Parliament has been amended recently: the agreement clearly permits the involvement, including at a formal level, of Parliament in the negotiation of international agreements in areas of Community competence, and this certainly comes under Community competence.

I should like to highlight ten areas in which concrete measures must be adopted: firstly, legislation must be enacted in the field of data protection under the third pillar, providing guarantees equivalent to those set out in Directive 95/46/EC under the first pillar; secondly, a common integrated management policy for the Member States’ external borders must be created, with Community funding; thirdly, the Council must adopt the two remaining proposals for directives that are needed to be able to complete the first phase of the common European asylum system; fourthly, the Council must approve the proposals that are currently blocked and which are intended to establish a common policy in the field of immigration; my fifth point is that a tangible proposal must be submitted on developing the visa information system (VIS); sixthly, we must be presented with a proposal for a framework decision on procedural safeguards for suspects and defendants in EU criminal proceedings; seven: because bringing the Schengen acquis into the sphere of Community competence has enabled greater coordination to take place between the police and judicial services of the Member States in their fight against organised crime, it is now crucial that we move ahead, as swiftly as possible, on creating the new SIS II; my eighth point is that progress on police cooperation must be promoted, by means of a legal process, as Commissioner Vitorino pointed out, that is less complex and cumbersome than the Europol Convention, involving Union-level judicial and democratic scrutiny; my ninth point is that we must continue to conclude stabilisation and association agreements with the States in the Western Balkans region in the fields of combating organised crime, the power of the judiciary, the war on drugs, border management and immigration; my tenth and last point is that there must be supervision of the Community acquis’ implementation in the enlargement countries especially as regards the field ...
Ik wil graag wijzen op tien punten waarvoor snel concrete maatregelen moeten worden genomen. Om te beginnen moet er wetgeving worden uitgevaardigd voor gegevensbescherming binnen de context van de derde pijler. Die wetgeving moet garanties geven van hetzelfde niveau als de garanties die uit hoofde van richtlijn 95/46/EG binnen het kader van de tweede pijler gelden. Ten tweede zal er een door de Gemeenschap gefinancierd gemeenschappelijk beleid moeten worden ontwikkeld voor het geïntegreerd beheer van de buitengrenzen van de lidstaten. Ten derde moet de Raad nog twee ontwerprichtlijnen aannemen om de eerste fase van een gemeenschappelijke Europese regelgeving voor asiel af te kunnen sluiten. Ten vierde is de Raad bij een aantal voorstellen voor het vaststellen van een gemeenschappelijk immigratiebeleid in een impasse geraakt. Die voorstellen zullen alsnog moeten worden aangenomen. Ten vijfde moet ons een voorstel worden voorgelegd met betrekking tot de ontwikkeling van het visuminformatiesysteem (VIS). Ten zesde willen wij een voorstel voor een kaderbesluit over processuele waarborgen voor aangeklaagden in het kader van strafvorderingprocessen in de EU. Ten zevende maakt de communautisering van het Schengen-acquis een betere coördinatie mogelijk tussen de politiële en justitiële diensten bij de bestrijding van de georganiseerde misdaad. Het is zaak dat we nu zo snel mogelijk verder gaan met de ontwikkeling van het nieuwe SIS II. Ten achtste moet er nu gewerkt worden aan de verbetering van de politiële samenwerking, en dat kan - de heer Vitorino heeft dat zojuist al gezegd - als we een snellere en minder ingewikkelde procedure ontwikkelen dan die welke in de Europol-overeenkomst is vastgelegd. Op die procedure moet op Europees niveau juridisch en democratisch toezicht kunnen worden uitgeoefend. Ten negende moeten wij de stabilisatie- en associatieovereenkomsten met de staten in de westelijke Balkan verder ontwikkelen. Het gaat dan om de bestrijding van de georganisee ...

In addition to the specific areas of Community competence identified by the Court, the application of AETR case-law to international civil aviation means mutatis mutandis that the Community has competence in respect of several other matters covered by the agreements in question and by Community law.

Article 13 of the EC Treaty enables the Community to combat discrimination, be it on the grounds of sex, racial or ethnic origin, religion or belief, disability, age and sexual orientation, in the areas of Community competence, and the Community has already made use of these new provisions in particular in the in the areas of employment and occupation.

Considers that, in this area of competences, Community legislation is justified only where European interests are at stake; in such cases, Community legislation must establish the guidelines, general principles and objectives, whilst the Member States must be responsible for the detailed transposition thereof into their domestic legal systems in accordance with the principles of subsidiarity and proportionality; considers that Community legislation should aim to create uniformity only where there is a clear threat to equal rights or competition;

This Agreement shall not, until equivalent rights for individuals and economic operators have been achieved hereunder, affect rights assured to them through agreements binding one or more Member States, on the one hand, and Russia, on the other, except in areas falling within Community competence and without prejudice to the obligations of Member States resulting from this Agreement in areas falling within their competence.
