(5) The Minister may present a budget for a controlled fiscal year that proposes program spending for any particular controlled fiscal year that exceeds the spending limit for the particular year if, at the same time, the Minister announces proposed amendments to this Act to increase that spending limit and, in that event, the proposed program spending for the particular year may exceed the spending limit for the particular year if it does not exceed the spending limit for the particular year as it would be if the proposed amendments were in effect.

39 (1) Notwithstanding anything in this Act, where an overpayment has been made by an employee on account of the employee’s contribution for a year under this Act, the Minister may, in accordance with any agreement that may be entered into by him with the approval of the Governor in Council with the appropriate authority of a province having the administration of the provincial pension plan referred to in subsection 8(2), if application in writing is made to the Minister by the employee not later than four years after the end of the year, refund to the employee the whole amount of the excess referred to in that subsection, in which case the whole of that amount shall be deemed to be an overpayment made by the employee on account of his contribution for that year under this Act.

Urges the Agencies to standardise the structure of their AARs in accordance with the format used by the Commission’s Directorates-General (DGs) and, accordingly, to provide detailed and complete information on: the implementation of their AWP, budget and staff policy plan, indicators for the budgetary management such as year-end spending (i.e. the budget commitments made by the Agency in the final three months of the year), management and internal control systems, internal/external audit findings, the follow-up to the audit recommendations, the discharge recommendation, and the statement of assurance of the Executive Director; calls also on the Agencies to provide in their AARs information resulting from the Financial Statements and from the report on budgetary and financial management foreseen in the context of the discharge procedure, provided the time constraints of the preparation of the Union annual consolidated accounts are respected;

Should there be no agreement in the Doha Round negotiations, then the EU will freeze its cuts for up to two years. This means that should there be no agreement once the EU cuts its tariffs to €132 per tonne, it will make no further cuts for up to two years, until the end of 2015 at the latest, then from 2016 at the latest, the EU will continue cutting its tariff each year, as agreed until the tariff reaches €114/t on 1 January 2019 at the latest.
