In anti-dumping investigations concerning imports from the People's Republic of China, Vietnam and Kazakhstan and any non-market-economy country which is a member of the WTO at the date of the initiation of the investigation, the normal value shall be determined in accordance with paragraphs 1 to 6, if it is shown, on the basis of properly substantiated claims by one or more producers subject to the investigation and in accordance with the criteria and procedures set out in point (c), that market-economy conditions prevail for this producer or producers in respect of the manufacture and sale of the like product concerned.

ensure that Kazakhstan’s participation in the Russian-led Customs Union and the Eurasian Economic Union does not constitute a barrier to trade or to economic and financial cooperation with the EU, or to fulfilling its obligations arising from WTO membership, and is not an obstacle to closer cooperation between the EU and Kazakhstan; points out that competition will result if the conclusion of the enhanced partnership and cooperation agreement is delayed; be ready to assist Kazakhstan’s efforts to promote modern economic institutions, should such efforts be undertaken;

5. Encourages Kazakhstan to take the necessary steps to swiftly conclude negotiations on its accession to the WTO, bring its legislation into conformity with WTO rules, including on local content requirements under the Agreement on Trade Related Investment Measures (TRIMs), and pave the way for structural reforms and the creation of a working market economy;
5. encourage le Kazakhstan à prendre les mesures nécessaires pour conclure rapidement les négociations relatives à son adhésion à l'OMC, aligner sa législation sur les règles de l'OMC, notamment sur les exigences de contenu local au titre de l'accord sur les mesures concernant les investissements et liées au commerce (MIC) et ouvrir la voie à des réformes structurelles et à la création d'une économie de marché fonctionnelle;

13. Takes note of the roadmap for Kazakhstan's WTO accession, which will contribute to creating a level playing field for business communities on both sides and will facilitate and liberalise trade, and sends out a message of cooperation and openness; stresses that with accession Kazakhstan will be obliged to comply with all WTO rules, including the elimination of protectionist measures;
13. prend bonne note de la feuille de route concernant l'adhésion du Kazakhstan à l'OMC, qui contribuera à l'instauration de conditions plus équitables pour les entreprises des deux bords, facilitera et libéralisera les échanges et offrira un gage de coopération et d'ouverture; souligne que du fait de son adhésion à l'OMC, le Kazakhstan sera tenu de respecter toutes les règles de l'organisation, notamment la suppression de toute mesure protectionniste;

Takes note of the roadmap towards Kazakhstan's WTO accession which will help to create a more level playing field for business communities on both sides, will facilitate and liberalise trade and is a sign for cooperation and openness; stresses that with accession, Kazakhstan has the obligation to fulfil all WTO rules including the renouncement of protectionist measures;
