In order to reach consensus, the competent authorities should consider relevant criteria, which may include those set out in the Guidelines which were published in the Eurojust Annual Report 2003 and which were drawn up for the needs of practitioners, and take into account for example the place where the major part of the criminality occurred, the place where the majority of the loss was sustained, the location of the suspected or accused person and possibilities for securing its surrender or extradition to other jurisdictions, the nationality or residence of the suspected or accused person, significant interests of the suspected or accused person, significant interests of victims and witnesses, the admissibility of evidence or any delays that may occur.

5. Member States shall collect statistics on the number of persons refused entry, the grounds for refusal, the nationality of the persons who were refused entry and the type of border (land, air or sea) at which they were refused entry and submit them yearly to the Commission (Eurostat) in accordance with Regulation (EC) No 862/2007 of the European Parliament and of the Council of 11 July 2007 on Community statistics on migration and international protection .
5. Les États membres établissent un relevé statistique sur le nombre de personnes ayant fait l'objet d'une décision de refus d'entrée, les motifs du refus, la nationalité des personnes auxquelles l'entrée a été refusée et le type de frontière (terrestre, aérienne, maritime) auquel l'entrée leur a été refusée, et le transmettent chaque année à la Commission (Eurostat) conformément au règlement (CE) no 862/2007 du Parlement européen et du Conseil du 11 juillet 2007 relatif aux statistiques communautaires sur la migration et la protection internationale .
